HomeMy WebLinkAbout03/23/76Proceedings of Board of Commissioners City of Paducah March 23, 1976 At a Regular Meeting of the Board of Commissioners held in the Commission Chamber in the City Hall, Paducah, Kentucky, at 7: 30 p.m. on March 23, 1976, Mayor Murphy presided and upon call of the Roll the following answered to their names: Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Mayor Murphy offered motion, seconded by Commissioner Hornsby, that the reading of the Minutes for February 24 and March 9, 1976 be waived and that the Minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Mayor Murphy made the following appointments: The terms of office of Gresham Hougland and Noble Clark as members of the Urban Renewal and Community Development Agency expired on February 23, 19769, I hereby, subject to the approval of the Board of Commissioners, reappoint the said Noble Clark for a further term of four years, and appoint Jack Wilson for a term of four years, so that said Agency shall be composed of the following members: Thomas Lambert whose term expires February 23, 1977 Harold Alston whose term expires February 23, 1978 Dr. Wally O. Montgomery whose term expires February 23, 1979 Jack Wilson whose term expires February 23, 1980 Noble Clark whose term expires February 23, 1980. Commissioner Grumley offered motion, seconded by Commissioner Brumley, that the Board of Commissioners approve the action of Mayor William S. Murphy reappointing Noble Clark and appointing Jack Wilson as members of the Urban Renewal and Community Development Agency. Adopted on call of the Rol,,, Yeas, Commissioners Brumley , Grumley, Hornsby, Puryear and Mayor Murphy (5) . Mayor Murphy made the following appointment: The term of office of Harry Bolser as a member of the Paducah Golf Commission will expire on March 26, 1976, I hereby, subject to the approval of the Board of Commissioners, appoint Fred M. Kettler a member of said Commission for a term of four (4) years, so that same shall be composed of the following members: Frank Paxton whose term expires March 26, 1977 Glenn Schrader whose term expires March 26, 1978 James B. Mitchell whose term expires March 26, 1978 William B. Sturgis whose term expires March 26, 1979 Fred M. Kettler whose term expires March 26, 1980. Commissioner- Brumley offered motion, seconded by Commissioner Grumley, that the action of Mayor William S. Murphy appointing Fred M. Kettler a member of the Paducah Golf Commission, be approved. Wallace Mose Wilson - collector in Refus( resignation Settle claim of Barbara Peyton city of Paducah No. March 23, 1976 Commissioner Brumley offered motion, seconded by Commissioner Grumley, as follows: Upon recommendation of the City Manager , I move that the following personnel changes be made: 1 That the compensation of Don C. Vander Boegh, Jr. street construction inspector for the Engineering Department, be increased from $781.00 per month to $860.00 per month, effective March 29, 1976, and that he be authorized expenses for the use of his own automobile in his employment with the city at the rate of $0.15 per mile for all driving within McCracken County, and that the salary and auto expenses be paid from Federal Revenue Sharing Trust Fund Accounts Nos. 3100 and 3107. 2. That the compensation of Robert Patton, assistant electrical inspector, be increased from $810.00 per month to $890.00 per month, effective March 29, 1976, and that said salary be paid from Federal Revenue Sharing Trust Fund Account No. 3000. 3. That Susan Mills, a clerk -typist in the Inspection Department, receive a monthly salary increase from $510.00 per month (third step) to $555.00 per month, effective March 29, 1976, said salary to be paid from Federal Revenue Sharing Trust Fund Account No. 3000, and that she be entitled to such additional step increases as are provided for permanent clerk -typist employed by the City of Paducah. 4. That Connie Travelstead Harmon, a clerk -typist in the Finance Department, receive a monthly salary increase from $510.00 per month (third step) to $555.00 per month, effective March 29, 1976, said salary to be paid from Federal Revenue Sharing Trust Fund Account No. 1200, and that she be entitled to such additional step increases as are provided for permanent clerk -typist employed by the City of Paducah. Commissioner Grumley offered motion, seconded by Commissioner Brumley, that the Summary of income and expenses submitted by the Kelley Transportation. Company, Inc. for bus service within the City of Paducah for the month of February , 1976 , be received and filed. Adopted on call of the Roll, Yeas., Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the claim of Fred W. Wallace in the amount of $1, 325.00 for damage to his 1971 Ford automobile when struck by a police car driven by Officer Raymond E. Dalli, at 28th & Clay Streets on March 8, 1976, be allowed. I further move that the City Treasurer be authorized to pay the sum of $1, 000.00 to the said Fred W. Wallace, the balance in the amount of $325.00 to be paid by the City's insurance carrier, the Continental Insurance Company. Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that upon recommendation of the City Manager the following personnel changes be made: 1. The resignation of Mose Wilson, collector, Refuse Department, retroactive to March 15, 1976, be received and accepted. Adopted on call of the Roll , Yeas , Commissioners Brumley , Grumley , Hornsby, Puryear and Mayor Murphy (5) . Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the V claim of Barbara Peyton, Route #5, Box 555A, Houser Road, in the amount of $77.93 for damage to her 1971 Monte Carlo when gravel fell from of truck being driven by Floyd Keeling at Schneidman Proceedings of Board of Commissioners City of Paducah and Old Mayfield Roads , on March 15 , 1976 , be allowed , and that the city treasurer pay said claim after first obtaining a complete and final release. Adopted on call of the Roll, Yeas, Commissi- oners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that a certified copy of the Judgment in Civil Action No. 11394, McCracken Circuit Court, styled Wayne Sullivan et al, Plaintiff, vs. City of Paducah, Defendant, be received, approved and filed. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that a copy of the Resolution adopted by the Electric Plant Board on February 25, 1976 pertaining to the Schedule of Rates and Charges, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the report of the Paducah Planning Commission setting forth it's reasons for recommending the rezoning of property located on Blow Avenue, North of Paxton Street, from R-4, High Density Residential Zone to M-2, Heavy Industrial Zone, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the Certificate of Insurance issued by The Aetna Casualty and Surety Company to the City of Paducah covering work done by Roe Wilkins & Wilkins Construction Company. Inc. from April 24, 1975 to April 24 , 1976 , be received, approved and filed. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Mayor Murphy offered motion, seconded by Commissioner Grumley, as follows: I move that the Charges preferred on this date by Leon Dodge, Chief of the Fire Department of the City of Paducah, Kentucky, against Ronald D. Burrows, a member of the said Fire Department, be received and filed, and I further move that a hearing on said Charges be held on March 26, 1976, at the hour of 5: 30 o'clock p.m., in the Commission Chambers of the City Hall in Paducah. Kentucky, and that the City Clerk immediately notify the said Ronald D. Burrows of such charges against him, and the date, time and place of said hearing by having a true copy of said charges served upon him, together with the Notice of the date, time and place of hearing. Commissioner Grumley offered motion, seconded by Commissioner Brumley, that an ordinance entitled "AN ORDINANCE AMENDING SECTION 2-47 'NONCIVIL SERVICE EMPLOYEES GENERALLY' OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH , KENTUCKY", be adopted. Adopted on call of the Roll, Yeas , ' Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Commissioner Grumley offered motion, seconded by Commissioner Brumley, that an ordinance entitled "AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH , BY ANNEXING CERTAIN PROPERTY LYING ADJACENT TO THE EAST CORPORATE LIMITS OF THE CITY, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN SAID CORPORATE LIMITS" , be adopted. Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that an ordinance entitled "AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXTEND THE CONTRACT WITH WILKINS CONSTRUCTION COMPANY, INC. , DATED JULY 10, 1974 FOR THE PURPOSES OF CONSTRUCTION OF CONCRETE CURBS, GUTTERS, SIDEWALKS AND DRIVE APRONS IN THE CITY OF PADUCAH , TO AND INCLUDING JUNE 30, 1976, AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL CONTRACT DOCUMENTS PERTAINING THERETO" , be adopted. Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that an ordinance entitled "AN ORDINANCE ADOPTING THE RELOCATION PLAN AND GRIEVANCE PROCEDURES AS REQUIRED BY THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 AND THE UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES ACT OF 1970, WHICH COVER ANY COMMUNITY DEVELOPMENT PROGRAM OR COMMUNITY DEVELOPMENT ASSISTED PLAN OR PROGRAM BY THE CITY OF PADUCAH , AND DECLARING AN EMERGENCY TO EXIST", be adopted. TO ACT AS FISCAL AGENTS FOR THE CITY OF PADUCAH , KENTUCKY , IN CONNECTION WITH THE ISSUANCE OF CITY OF PADUCAH SPECIAL ASSESSMENT BONDS", be adopted. Mayor Murphy offered motion, seconded by Commissioner Hornsby, that an ordinance entitled "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED ON BLOW AVENUE, NORTH OF PAXTON STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE -1971 SO AS TO EFFECT SUCH REZONING". be adopted. Mayor Murphy offered motion,, seconded by Commissioner Grumley , that an ordinance entitled "AN ORDINANCE AMENDING SECTION 12-28 OF ARTICLE II, FIRE DEPARTMENT, AND SECTION 25-19 OF ARTICLE I, POLICE DEPARTMENT, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY: , be adopted. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) . Mayor Murphy offered motion, seconded by Commissioner Grumley, that an ordinance entitled "AN ORDINANCE AMENDING SECTIONS 10-49; 10-51; 10-52; 10-55; 10-56; 10-58; 10-59 and 10-61, AND REPEALING SECTION 10-50 OF CHAPTER 10 'CIVIL SERVICE' OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY", be adopted.
