HomeMy WebLinkAbout2009-4-7538ORDINANCE NO. 2009-4-753 8 AN ORDINANCE ACCEPTING THE BID OF VULCAN MATERIALS COMPANY FOR SALE TO THE CITY OF ITS REQUIREMENT OF LIMESTONE, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City accepts the bid of Vulcan Materials Company, for sale to the City of its requirement of limestone, for the 2009-2010 calendar year, with a one-year option to renew, said bid being in substantial compliance with the bid specifications, and as contained in the bid of Vulcan Materials Company, of March 25, 2009, for the following prices: DESCRIPTION UNIT TO BE DELIVERED UNIT PRICE #11 Tons $14.25 #3 Tons $13.50 #57 Tons $13.50 #68 Tons $14.25 #9M Tons $14.75 DGA Tons $12.75 DGA — Pugged Tons $13.25 #125 Rip Rap Tons $15.50 8" Rip Rap Tons $15.50 8" Minus Rip Rap L Tons $12.25 Said bid prices may be adjusted in accordance with Section 109.07 "Price Adjustments" of the Kentucky Transportation Cabinet Department of Highways Standard Specifications for Road and Bridge Construction, latest edition. SECTION 2. The Mayor is hereby authorized and directed to execute a contract with Vulcan Materials Company, for sale to the City of the material authorized in Section 1 above, according to the specifications, bid proposal and all contract documents heretofore approved and incorporated in the bid of March 25, 2009. accounts. The contract shall be binding upon the City and the Contractor, his partners, successors, assigns and legal representatives for 2009-2010 calendar year ending December 31, 2010. Neither the City nor the Contractor shall have the right to assign, transfer, or sublet their interests or obligations hereunder without consent of the other party. The term of the contract shall be renewable for an additional one-year term, ending December 31, 2011, upon the mutual agreement of both parties. The Board of Commissioners of the City of Paducah hereby authorizes the City Engineer, in his sole discretion, to exercise this renewal option. This renewal option shall be exercised by both parties executing and delivering the written One -Year Renewal Agreement prior to the expiration of the original term of the contract. The City reserves the right to order the limestone at the quoted prices until the parties have executed the ,- -,rte,. �_ .7,7'-..._- One -Year Renewal Agreement. However, in no case shall the Seller be bound to sell the contract material at these prices past December 31, 2010. SECTION 5.
