HomeMy WebLinkAbout2009-4-7536ORDINANCE NO. 2009-4-7536 AN ORDINANCE ACCEPTING THE BID FOR THE CITY OF PADUCAH' S 2009-2010 CONCRETE PROGRAM, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Mayor is hereby authorized and directed to execute a contract with Wilkins Construction Company, Inc., for concrete work at the unit prices and hourly rates as authorized in Section 1 above, according to the specifications, bid proposal and contract documents heretofore approved and incorporated in the bid of March 25, 2009. SECTION 3. Expenditures for the City's concrete program shall be charged to various accounts. SECTION 4. The contract shall be binding upon the City and the Contractor, his partners, successors, assigns and legal representatives for the 2009-2010 calendar year ending December 31, 2010. Neither the City nor the Contractor shall have the right to assign, transfer, or sublet their interests or obligations hereunder without consent of the other party. The term of the contract shall be renewable for an additional one-year term, ending December 31, 2011, upon the mutual agreement of both parties. The Board of Commissioners of the City of Paducah hereby authorizes the City Engineer, in his sole discretion, to exercise this renewal option. This renewal option shall be exercised by both parties executing and delivering the written One -Year Renewal Agreement prior to the expiration of the original term of the contract. The City reserves the right to have concrete work completed at the quoted prices until the One -Year Renewal Agreement has been executed by the parties. However, in no case shall the Contractor be bound to complete the work at these prices past December 31, 2010. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: Tammara S.
