HomeMy WebLinkAbout2009-4-7535ORDINANCE NO. 2009-4-7535 AN ORDINANCE ACCEPTING THE BID OF JIM SMITH CONTRACTING COMPANY, LLC, FOR THE CITY'S 2009-2010 STREET RESURFACING PROGRAM, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah accepts the bid of Jim Smith Contracting Company, LLC, for the City's 2009-2010 street resurfacing program with the option of a one- year extension, said bid being in substantial compliance with the bid specifications and advertisement for bids, and as contained in the bid of Jim Smith Contracting Company, LLC, of March 25, 2009. SECTION 2. The City of Paducah accepts the bid of Jim Smith Contracting Company, LLC, for roadway resurfacing, repair, and miscellaneous construction of various streets within the City of Paducah at the following unit bid prices: ITEM NO DESCRIPTION UNIT UNIT BID PRICES 1 Bituminous Surface/Base TON $70.10 2 Milling Texture TON $45.00 3 Traffic Signal Loop Wire L.F. $2.50 4 Traffic Signal Loop — Saw, Slot and Fill L.F. $16.00 5 Shoulder Construction TON $37.00 Said bid prices may be adjusted in accordance with Section 109.07 "Price Adjustments" of the Kentucky Transportation Cabinet Department of Highways Standard Specifications for Road and Bridge Construction, latest edition. SECTION 3. That the Mayor is hereby authorized to execute a contract with Jim Smith Contracting Company, LLC, for roadway resurfacing, repair, and miscellaneous construction of various streets as set out in Sections 1 and 2 above, according to the specifications, bid proposal and all contract documents heretofore approved and incorporated in the bid. Account. SECTION 4. This expenditure shall be charged to the Street Rehabilitation SECTION 5. The contract shall be binding upon the City and the Contractor, his partners, successors, assigns and legal representatives for the 2009-2010 calendar year ending December 31, 2010. Neither the City nor the Contractor shall have the right to assign, transfer, or sublet their interests or obligations hereunder without consent of the other party. The term of the contract shall be renewable for an additional one-year term, ending December 31, 2011, upon the mutual agreement of both parties. The Board of Commissioners of the City of Paducah hereby authorizes the City Engineer, in his sole discretion, to exercise this renewal option. This renewal option shall be exercised by both parties executing and delivering the written One -Year Renewal Agreement prior to the expiration of the original term of the contract. The City reserves the right to have roadway resurfacing, repair, and miscellaneous construction of various iT-r streets completed at the quoted prices until the parties have executed the One -Year Renewal Agreement. However, in no case shall the Contractor be bound to complete the work at these prices past December 31, 2010. SECTION 6. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. AT TEST: _�- 127,10 VV Tammara S.
