At a Called Meeting of the Board of Commissioners, held in the Commission Chambers
of City Hall at 11:00 a.m., Tuesday, June 27, 2006, Mayor Paxton presided, and upon
call of the roll by the City Manager's Intern, the following answered to their names:
Commissioners Sirk, Guess, Coleman and Mayor Paxton (4). Commissioner Smith was
absent (1).
MOTIONS
R & F CALLED MEETING NOTICES
Commissioner Coleman offered motion, seconded by Commissioner Guess, that the
Board approve a motion that the Notices of Called Meeting for 11:00 a.m., Tuesday,
June 27, 2006 be received and filed. Adopted on call of roll, yeas, Commissioners Sirk,
Guess, Coleman and Mayor Paxton.
The Issue being discussed was sewer problems in the Buckner Lane neighborhood.
Residents issued complaints regarding sewage backup in their basements due to recent
heavy rains.
The meeting opened with testimony from Doug Moore, Director of the Joint Sewer
Agency. Mr. Moore explained that he received a complaint recently, went to check on
the situation, and concluded that the sewer system (a combined storm and sanitary
system) in the area was in working as it was designed to work when it was built many
years ago. He notified the homeowners that it was not negligence on the part of JSA
according to the insurance company. Problems like this have occurred in the past; it is
not a recent problem. There has been no added flow to this particular system in the last
30 years.
Those residents that attended and issued complaints included:
Kenneth Hall -3468 Buckner Lane
Mr. Hall explained that he had 6" of sewage water in his basement after a recent rainfall
event. He installed a backflow valve, and the cost for the valve was only $300, but it
cost $4,000 to install.
Betty Smith -3460 Buckner Lane
Ms. Smith pointed out that the problem is getting worse because of increased parking
lots in the area.
Henrietta Ross -301 N. 36th St. (corner of Friedman)
Ms. Ross pointed out that the seriousness of problem not disclosed to her at the time of
closing on her house. Now she has concerns about the resale value of her home.
Rick Colthorp-203 Cedar Lane
Mr. Colthorp asked a question regarding a sewer engineering study done 30 years ago.
The study, as he recalls, had three phases. He thinks that only one phase was completed
by the City 4 Rick Murphy, City Engineer would have to research.
Frederick (last name not given)
Frederick wanted guidance on how to disinfect his house to make it safe.
Wayne (last name not given)
Wayne expressed concern regarding the new Westwood development adding to the
capacity problem of the system. Doug Moore responded that this was considered, and
that the Westwood development was attached to a totally different system.
After testimony the Commission responded thus:
Mayor Paxton pointed out that the long-range goal is to update and upgrade the system,
but that will take a lot of time and tens of millions of dollars.
Commissioner Coleman pointed out that these infrastructure problems are not unique to
Paducah. It is happening all over the nation. The City needs to find out what kind of
federal assistance it can get to solve this problem. He will contact the National League
of Cities to find out what kind of assistance is available.

Commissioner Sirk and Guess said they would like to get a handle on the magnitude of
the problem. How many homes are affected and in what way are they affected?
Mayor Paxton said the only thing to do about the situation now is for the Commission to
get together and talk about it. He asked the press to ask residents to come forward that
did not show up today and tell JSA where they live and what their problem is.
