(4) . Mayor Murphy was absent (1) . Mayor Protem Coleman offered motion, seconded by Commissioner Puryear, that the reading of the Minutes for January 9, 19.79 be waived and that the Minutes of said meeting prepared by the City Clerk be approved as written. Adopted on. call of the Roll, Yeas, Commissioners Grumley, Meeks, Puryear and Mayor Protem Coleman (4) . Commissioner Grumley offered motion, seconded by Commissioner Puryear, that upon recommendation of the City Manager, I move that the following personnel changes be made in the Refuse Department: 1. The following be employed as collectors at a salary of $4.35 per hour, retroactive to January 15, 1979: Loretta Dowdy at 4: 00 a.m. Denver C. Parman at 6: 00 a. m. 2. Steve N. Sharpton be employed as collector, at a salary of $4.35 per hour, retroactive to January 16, 1979. Commissioner Grumley offered motion, seconded by Commissioner Puryear, that the Board of Commissioners approve the sale by the City of Paducah of the following cemetery lots, and that the City Clerk be authorized to execute a deed of conveyance to said cemetery graves: 1. Joe Lee Wilson, the southwest corner of Lot No. 33, Block 6, Rushing Addition, for the sum of $100.00 (Receipt No. 24008) . 2. Donna Humphrey for Jerry C. Troutman, Lot 107 in Section 30-C Old Addition of Oak Grove Cemetery, for the sum of $100.00, (Receipt No. 24003) . 3. Hamock Funeral Home for Arthur Davenport,, the southwest - A corner of Lot 39 , Block 6 , Rushing Addition, for the sum of $100.00, (Receipt No. 24011) . Commissioner Meeks offered motion, seconded by Commissioner Puryear, that upon recommendation of the City Manager, I move that the following personnel changes be made in the Refuse Department: 1. The resignation of Steve Sharpton, collector, be received and accepted retroactive to January 17, 1979. Commissioner Meeks offered motion, seconded by Commissioner Puryear, that upon recommendation of the City Manager, I move that the following personnel changes be made in the Parks and Recreation Department: 1. Commissioner Meeks offered motion, seconded by Commissioner Puryear, that the following Planning Commission reports be received and filed: 1. Requesting Section 59A be added to Section 59 of the Paducah Zoning Ordinance - 1976. 2. Request to rezone from R-4, High Density Residential Zone to M-2, Heavy Industrial Zone,, property on Bloom Ave 3. Request to rezone property on Buckner Lane, which request was denied. 4. Request to rezone from R-3, Medium Density Residential Zone to B-3, General Business Zone, property on Joe Bryan Drive to operate a beauty shop. Adopted on call of the Roll, Yeas, Commissioners Grumley, , Meeks, Puryear and Mayor Protem Coleman (4) . 1928, and Commissioner Puryear offered motion, seconded by Commissioner Meeks, that WHEREAS, a 1928 General Fire Truck was purchased by the City in WHEREAS, said truck has been surplus since 1965 and is now in storage, and WHEREAS, the City contemplates no further use of said fire truck, I now, therefore, move that the City Manager be, and he is hereby, authorized to advertise for bids for sale by the City of one 1928 General Fire Truck. Commissioner Puryear offered motion, seconded by Commissioner Meeks,, that upon recommendation of the City Manager, I move that the following personnel changes be made in the Police Department: 1. The retirement of Everett Dunlap, captain, be received and accepted retroactive to January 2, 1979. Report of the Electric Plant Board pertaining to its schedule of rates and charges. 2. Report of the Paducah Water Works for November, 1978. 3. Executed copy of the contract between the City and Allan Rhodes Ford and Honda, for the purchase of Police automobiles. 4. Bid of Midwest Fire & Safety Equipment Company, Inc . , for the purchase of One Hurst Model 32A "Jaws -of -life" equipment. Mayor Protem Coleman offered motion, seconded by Commissioner Puryear, that WHEREAS, the Paducah Police Department has three automobiles that have been damaged or have become obsolete, and WHEREAS, the Police Department would like to sell said automobiles and a notice for bids was advertised in the Paducah Sun and bids were received at the office of the City Manager,, I now therefore move that the damaged 1977 Ford LTD Il,, 4 -door automobile be sold to James Grief, Grief Body Shop, for the sum of $750.00; that the 1972 Ford Pinto be sold to J. W. Cunningham, Route #2, Rebecca Drive, for the sum of $400.00; and that the 1974 Ford Station Wagon be sold to William J. Schilling, 2946 Georgia Street, for the sum of $755.00; and I further move that said bids be received and filed. Mayor Protem Coleman _offered motion, seconded by Commissioner Puryear, that upon recommendation of the City Manager, I move that the following personnel changes be made in the Floodwall Department: 1. Joe B. Peck be employed as temporary pump operator at a salary of $2.56 per hour, retroactive to January 7, 1979. Adopted on call of the Roll, Yeas, Commissioners Grumley , Meeks , Puryear and Mayor Protem Coleman (4) . follows: Commissioner Grumley offered motion, seconded by Commissioner Puryear, as WHEREAS, Kentucky Revised Statutes permit the adoption of an resolutions by reference to a summary thereof; I therefore move that a resolution reciting the need for acquiring a certain parcel of land belonging to Mary Bell Connor, single, to be used for the completion of the Interim Community development Plan and providing for and authorizing the condemnation of same, and as appended in full hereto be introduced and adopted according to law. Commissioner Meeks offered motion, seconded by Commissioner Puryear, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of resolutions by reference to a summary thereof; I therefore move that a resolution requesting the City Manager to advertise for bids for the purchase of one new 1979 pickup truck to be used in the Street Department, and as appended in full hereto be introduced and adopted according to law. Commissioner Puryear offered motion, seconded by Commissioner Meeks, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of resolutions by reference to a summary thereof; I therefore move that a resolution authorizing the City Manager to advertise for bids for furnishing the City of Paducah with a public bus transportation system, and as appended in full hereto be introduced and adopted according to law. Commissioner Puryear offered motion, seconded by Commissioner Meeks, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of resolutions by reference to a summary thereof; I therefore move that a resolution requesting the City Manager to advertise for bids for furnishing the City of Paducah with its requirement for new and recapped automobile and truck tires, for the period of time from January 1, 1979 to December 31, 1979 and as appended in full hereto be introduced and adopted according to law. Adopted on call of the Roll, Yeas, Commissioners Grumley, Meeks, Puryear and Mayor Protem Coleman (4) . follows: Mayor Protem Coleman offered motion, seconded by Commissioner Puryear, as WHEREAS, Kentucky Revised Statutes permit the adoption of resolutions by reference to a summary thereof; I therefore move that a resolutions authorizing the Mayor to execute the First Year Funding Agreement for a Small Cities Grant No. B -78 -ND -21-0054, and as appended in full hereto be introduced and adopted according to law. No. 10 Proceedings of Board of Commissioners GO of Paducah January 23, 1979 Commissioner Grumley offered motion, seconded by Commissioner Puryear, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference to a summary thereof; I therefore move that an ordinance amending sections 28-29 and 28-30, Liability Insurance and Agreement in Lieu of Liability Insurance of Article II, Street Cuts , of the Code of Ordinances of the City of Paducah, increasing the amounts of insurance required, and as appended in full hereto be introduced and adopted according to law. Adopted on call of the Roll, Yeas, Commissioners Grumley, Meeks, Puryear and Mayor Protem Cole- man (4) . follows: Commissioner Grumley offered motion, seconded by Commissioner Puryear, as WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference to a summary thereof; I therefore move that an ordinance accepting the bid of Kentucky Machinery, Inc . , for sale to the City of Paducah of a new Fiat -Allis FL14C Crawler Front End Loader, to be used by the Refuse Department, for a sum not to exceed $68,,800.00, less monthly rental credits, and as appended in full hereto be introduced and adopted according to law; this being the second and final reading. Adopted on call of the Roll, Yeas, Commissioners Grumley, , Meeks, Puryear and Mayor Protem Cole- man (4) . follows: Mayor Protem Coleman offered motion, seconded by Commissioner Meeks, as WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference to a summary thereof; I therefore move that an ordinance approving the final report of the Paducah Planning Commission rezoning property in an area bounded by Joe Bryan Drive, Guthrie Avenue, Goebel Avenue and South 16th Street, from R-3, Medium Density Residential Zone to B-3, General Business Zone, and as appended in full hereto be introduced and adopted according to law. The next business to come before the Board was the grievance, Step #4, filed by Joe Wyatt, an employee of the Floodwall Department. After hearing testimony by Joe Wyatt for approximately 30 minutes, Commissioner Grumley offered motion, seconded by Commissioner Puryear, as follows: "Pursuant to the provisions of the contract between the City of Paducah and 11 No. 12 Proceedings of Board of Commissioners I City of Paducah JanLary 2. 1, 1979 Local 1586, AFSCME , a hearing on the grievance of Joe Wyatt was conducted by the Board of Commissioners on January 23, 1979, at the regular meeting of the Board. The Board, having heard statements from both management and the union and having thoroughly considered the issue involved, does hereby find that there is no violation of the Union contract or Civil Service statutes, and the aforesaid grievance is accordingly denied". Commissioner Puryear offered motion, seconded by Commissioner Meeks, that the Board retire to Executive Session for the purpose of interviewing Police applicants.
