HomeMy WebLinkAbout12/01/86No. 585 Proceedings of Board of Commissioners City of Paducah December 1, 1986 At a Called Meeting of the Board of Commissioners held in the Commission Chambers, City Hall, at 6:00 p.m. on December 1, 1986, Mayor Viterisi presided and upon call of the roll, the fol- lowing answered to their names: Commissioners Cole, Ford, Grumley and Mayor Viterisi (4). Commissioner Coleman was absent (1). Commissioner Cole offered motion, seconded by Commissioner Ford, that the executed copies of the Notice of Called Meeting to be held at 6:00 p.m., Monday, December 1, 1986, be received and filed. Adopted on call of the roll, yeas, Commissioners Cole, Ford, Grumley and Mayor Viterisi (4)-. The meeting was called for the purpose of reconvening a hearing held on February 7, 1986, to WILFORD Disciplinary Hearing hear charges against Patrolman Terry L. Wilford, brought by Chief Robert L. Patterson. Wilford appeared in person, with his attorneys, Hon. Todd Megibow and Hon. Jim Glanville. Hon. James W. Utter represented Chief Patterson, and Hon. Daniel Key served as legal advisor to the Board of Commissioners. Detailed testimony was taken by court reporter Pat Burrall. Mr. Utter called the following witnesses: Police Officers Paul Carter, Frank Burch, Steve Haines, and Leroy Humphrey. Mr. Megibow called the following witnesses: Karlene Hatton Charlotte Pugh Officer Bob Carr State Trooper Bobby Ham It was agreed by both parties to stipulate the testimony of sixteen additional police officers regarding the reputation of Paul Browning. Mr. Megibow and Mr. Utter presented closing statements. Findings of Fact & Order II After deliberations by the Board, Mayor Viterisi read the following Findings of Fact and Order: "From the evidence presented, the Board finds as follows: "That the defendant, Terry L. Wilford, on or about January 28, 1986, is guilty of a violation of the rules adopted by the legislative body of the City of Paducah, Kentucky, by not divulging to his supervisor the incident regarding the discharge of his service revolved within the vehicle and in close proximity of the head of Paul Browning, and that this failure to disclose materially affected the decision of his supervisor not to require an immediate written report, in violation of the Manual of Rules and Procedures of Police Department, Section II, Chapter III. "NOW, THEREFORE, it is the order of this Board that Terry L. Wilford be suspended without pay for fifteen (15) working days, effective January 1, 1987." Commissioner Grumley offered motion, seconded by Commissioner Ford, that the Findings of Fact and Order by adopted by the Board of Commissioners of the City of Paducah, Kentucky. Adopted on call of the roll, yeas, Commissioners Cole, Ford, Grumley and Mayor Viterisi (4). Entered this 1st day of December, 1986. ADOPTED: 4.t°1, g, /CJ w6 U City Clerk Mayor
