Thomasson At a Called Meeting of the Board of Commissioners held in the Commission Chambers, City Hall, at 5:30 p.m. on November 20, 1985, Mayor Viterisi presided and upon call of the roll, the following answered to their names: Commissioners Cole, Coleman, Ford, Grumley and Mayor Viterisi (5). This meeting was held for the purposes of conducting a hearing on the charges filed by Captain Gladman Humbles against Lieutenant Marion (Buddy) Thomason of the Fire Department. Alicia Pedroza, Court Reporter, was present at the meeting. Commissioner Coleman offered motion, seconded by Commissioner Cole, that the executed copies of the Notice of Called Meeting to be held at 5:30 p.m., Wednesday, November 20, 1985, be received and filed. Adopted on call of the roll, yeas, Commissioners Cole, Coleman, Ford, Grumley and Mayor Viterisi (5). The Board adopted "Rules to Govern Hearings". Rule No. 3 was amended to read that the voir dire of the Board of Commissioners shall not be permitted. Adopted on call of the roll, yeas, Commissioners Cole, Coleman, Ford, Grumley and Mayor Virterisi (5). Commissioner Grumley offered motion, seconded by Commissioner Ford, that the Board of Commissioners go into Executive Session for discussions which might lead to the discipline or dismissal of an individual employee. Adopted on call of the roll, yeas, Commissioners, Cole, Coleman, Ford, Grumley and Mayor Viterisi (5). At this time all witnesses were excused from the hearing chambers. at Law. The plaintiff, Gladman Humbles, was represented by Steven Bodell, Attorney The defendant, Marion (Buddy) Thomasson, was represented by Earl T. Osborne, Attorney at Law. Mr. Thomasson filed a motion asked the Board of Commissioners to dismiss Charge No. 9 of the Statement of Charges, as more fully set out in the written motion. After discussion the Board ruled that Charge No. 9 was too old to be considered as a charge against Mr. Thomasson; however, they would allow evidence as to the events for the use of background materials for fully understanding the charges filed by Captain Humbles against Lieutenant Thomasson. Steven Bodell made an opening statement on behalf of Captain Humbles. Earl Osborne made an opening statement on behalf of Lieutenant Thomasson. Witnesses were called on behalf of Captain Humbles, plaintiff, which included: Capt. Humbles, Lt. Sam Jackson, Capt. James Leneave, Relief Driver Charles Taylor, Capt. Thomas Brumlow, retired, and Frank Brown, Director of the Paducah Human Rights Commission, after which the plaintiff rested his case in chief. Motion was made on behalf of Lt. Thomasson for the Board to find him not guilty, based upon the evidence of the plaintiff, which request was turned down by I the Board of Commissioners. The defendant, Lt. Thomasson called on his behalf the following witnesses: ILt. Thomasson, Lt. Ken Holiday, and Chief Leon Dodge, after which the defendant Irested his case in chief. Thomason and followed by Steven Bodell on behalf of Capt. Humbles. The Board then retired to their chambers for discussion and returned with the following Order: Commissioner Grumley offered motion, seconded by Commissioner Ford: "I move that the Board adopt the following Order: There is a general consensus of the Board that Lt. Thomasson's conduct of November 6, 1985, was a violation of the Rules of Conduct regarding disrespect to a superior officer (Sec. 12-35(a)(3). The Board hereby reprimands Lt. Thomasson for his actions, and further states that the Board will not countenance any further misconduct of this nature. The reprimand is contingent upon Lt. Thomasson tendering a formal written apology to Capt. Humbles." Adopted on call of the roll, yeas, Commissioners Cole, Coleman, Ford, Grumley and Mayor Viterisi (5). Lt. Thomasson announced to the Board that he was withdrawing his charges against Capt. Humbles which were scheduled for a hearing on November 21, 1985. Upon motion the meeting adjourned.
