AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE THE
FEASIBILITY STUDY AND CERTIFICATION OF LEVEE SYSTEM AGREEMENT
BETWEEN THE DEPARTMENT OF THE ARMY AND THE CITY OF PADUCAH;
AUTHORIZING THE CITY ENGINEER TO EXECUTE THE PROJECT MANAGEMENT
PLAN WITH THE U.S. ARMY CORP OF ENGINEERS; AND AUTHORIZING THE
EXPENDITURE OF FUNDS FOR SAME
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves the Floodwall Feasibility
Study and Certification of Levee System Agreement between the Department of the Army and
the City and authorizes the Mayor to execute the contract for same.
SECTION 2. That the City of Paducah hereby authorizes the City Engineer to
execute the Project Management Plan with the U. S. Army Corp of Engineers that is attached to
the Agreement approved in Section 1 above.
SECTION 3. That the City of Paducah hereby authorizes the expenditures of
funds for this project in an amount not to exceed $397,000 from project account FW0002. The
funding of this account will be accomplished with the KLC Bonding Issue
SECTION 4. Pursuant to KRS 83A.060, the City Commission suspends the
requirement of a second reading and publication of this Ordinance. As grounds therefore, the
City Commission does hereby declare an emergency to exist in order to comply with the
scheduled terms of the Floodwall Feasibility Study and Certification of Levee System Agreement
and the timeline associated with the attached Project Management Plan (PMP), it is requested
that this ordinance be adopted as an emergency, as time is of the essence.
SECTION 5. This Ordinance shall become effective upon the first reading of this
Ordinance.
