HomeMy WebLinkAbout2008-12-7496ORDINANCE NO. 2008-12-7496 AN ORDINANCE AUTHORIZING THE MAYOR TO SELECT LOW BIDDER FOR THE JULIAN CARROLL CONVENTION CENTER PROJECT, PHASE II REHABILITATION, AND ISSUE LETTERS OF INTENT AND PURCHASE ORDERS WHEREAS, on October 21, 2008, the Board of Commissioners adopted Ordinance 2008-10-7473 authorizing the Mayor to enter in to a contract with DS Contractor's Inc. for Phase I, Demolition of the Julian Carroll Convention Center rehabilitation project; and WHERAS, on November 11, 2008, the Board of Commissioners adopted Ordinance 2008-11-7485 authorizing the Mayor to enter in a contract with Marcum Engineering for architectural and engineering services; and WHEREAS, pursuant to Chapter Two, Article VIII of the Paducah Code of Ordinances, advertisements for sealed bids for Phase II, Rehabilitation, were published on November 30, 2008 and December 7, 2008; and WHEREAS, sealed bids are to be received by the City of Paducah at 2:00 PM on December 19, 2008; and WHEREAS, time is of the essence. As the American Quilt Society's 2009 Quilt Show is in April, renovations must be completed prior to the show. Lengthy lead-time for certain electrical and mechanical components necessitate that the City take proactive action to initiate construction. BE IT ORDAINED BY THE CITY OF PADUCAH: SECTION 1. After bids are received on Phase II of the project on December 19, 2008, the Mayor, in consultation with the McCracken County Judge Executive, is hereby authorized to select the lowest qualified responsive bidder. This selection shall be made if the bid, after the project's architect and engineer provide analysis, is reasonably proximate to the project scope. SECTION 2. The Mayor is hereby authorized to issue a "letter of intent" to the lowest qualified responsive bidder selected in Section 1. The letter of intent, among other things, shall bind the city to approving a contract. The letter of intent shall remain in force until rescinded, altered by the City Commission or until such time an ordinance authorizing the contract is adopted. __–.....— 1LLY — 1. __ - __ SECTION 3. In the bidding documents, the City of Paducah has reserved the right to place orders and purchase certain commodities as specified in the bidding documents. The Finance Director and City Manager are hereby authorized to issue purchase orders for components specified in the bidding documents. SECTION 4. Pursuant to KRS 83A.060, the City Commission suspends the requirement of a second reading and publication of this Ordinance. As grounds therefore, the City Commission does hereby declare an emergency to exist due to the necessity to complete renovations to the convention center for use in the 2009 visitor season and in particular the April 2009 Quilt Show of the American Quilt Society SECTION 5. This Ordinance shall become effective upon the first reading of this Ordinance. ATTEST: Tammara S.
