AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO
PAY FOR SEEDING AND GROUND PROTECTION WITHIN THE WESTWOOD
HILLS SUBDIVISION
(0�I WHEREAS, Ordinance No. 2008-9-7464 was adopted September 23,
2008, accepting a draw, in the amount of $200,000, under the Irrevocable Stand-by Letter
of Credit, with respect to the Westwood Hills Subdivision, to complete required public
improvements within the subdivision; and
WHEREAS, a written determination has been made by the City Manager
that the services required for the completion of public improvements, such as seeding and
ground protection, within the Westwood Hills Subdivision prior to inclement weather
will be made pursuant to Sec. 2-659 of the Code of Ordinances of the City of Paducah,
Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Finance Director is hereby authorized to pay Eads, Inc.,
Landscape and Garden Center, the sum of $63,095.00, for seeding and ground protection
within the Westwood Hills Subdivision.
SECTION 2. Expenditures for this project shall be charged to the
(911i Westwood Hills Project Account.
SECTION 3. Pursuant to KRS 83A.060, the City Commission suspends
the requirement of a second reading and publication of this Ordinance. As grounds
therefore, the City Commission does hereby declare an emergency to exist due to the
contractor's necessity to make payment on materials already installed.
SECTION 4. This Ordinance shall become effective upon the first
reading of this Ordinance.
