HomeMy WebLinkAbout2008-10-7483ORDINANCE NO. 2008-10-7483 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FROM M-1, LIGHT INDUSTRY ZONE TO B-2, DOWNTOWN BUSINESS ZONE FOR PROPERTY ROUGHLY BOUNDED BY THE CITY OF PADUCAH FLOODWALL, CLARK STREET, SOUTH 2ND STREET, ADAMS STREET, SOUTH 3' STREET, OSCAR CROSS AVENUE, AND OHIO STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on October 6, 2008, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FROM M-1 (LIGHT INDUSTRY ZONE) TO B-2 (DOWNTOWN BUSINESS ZONE) FOR PROPERTY ROUGHLY BOUNDED BY THE CITY OF PADUCAH FLOODWALL, CLARK STREET, SOUTH 2ND STREET, ADAMS STREET, SOUTH 3RD STREET, OSCAR CROSS AVENUE, AND OHIO STREET," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from M-1, Light Industry Zone to B-2, Downtown Business Zone: Beginning at a point at the intersection of the centerlines of Clark Street and South 2nd Street; thence in a northeasterly direction toward the Ohio River following the Clark Street centerline 248' to a point; said point being the intersection of the Clark Street centerline and the eastern floodwall right of way line; thence in a southerly direction following the eastern boundary of the floodwall right of way 1,400' to a point; said point being the intersection of the eastern boundary of the floodwall right of way and the Ohio Street centerline; thence in a southwesterly direction 98' to a point; said point being the intersection of the centerlines of Ohio Street and South 2nd Street; thence in a northwesterly direction following the centerline of South 2nd Street 411' to a point; said point being the intersection of the centerlines of South 2nd Street and Oscar Cross Avenue; thence in a southwesterly direction following along the centerline of Oscar Cross Avenue 406' to a point; said point being the intersection of Oscar Cross Avenue and South 3rd Street; thence in a northwesterly direction following along the centerline of South 3rd Street 463' to a point; said point being the intersection of the centerlines of South 3rd Street and Adams Street; thence in a northeasterly direction following the centerline of Adams Street 412' to a point; said point being the intersection of the centerlines of Adams Street and South 2nd Street; thence in a northwesterly direction following along the centerline of South 2nd Street 491' to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: xnfryow Tammara S.
