HomeMy WebLinkAbout04/11/89Proceedings of Board of Commissioners No. City of Paducah At a Regular Meeting of the Board of Commissioners held in the Commission Chambers, City Mall, Paducah, Kentucky, at 1:30 p.m. on April 11, 1989, Mayor Pro -tem Leeper presided and upon call of the roll, the following answered 'to their names: Commissioners Coleman, Grumley, Keeling, and Mayor Pro -tem Leeper (4). Commissioner Coleman offered motion, Seconded by Commissioner Grumley, that the reading of the Minutes for March 28 and April 5, 1989, be waived and that the Minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro --tem Leeper ( 4) . Mayor Pro --tem Leeper made the following appointment: "WHEREAS, A.O. Miller has resigned as a member of the Paducah Planning Commission, I hereby, ,subject to the approval of the Board of Commissioners, appoint Ann Penny as a member of the Paducah Planning Commission to fill the unexpired term of Mr. Miller, which term will expire August 31, 1990. April 11. 1989 Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners approve the action of Mayor Pro -tem Leeper in appointing Ann Penny as a member of the Paducah Planning Commission. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Grumley offered motion, seconded by Commissioner Coleman that the following petition be received and filed: Petition signed by owners in Central Business District supporting demolition ordinance for Central Business District Adopted on call of the roll, yeas, Commissioners Coleman, Grtunley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Keeling offered motion, seconded by Commissioner Coleman, that the following documents be received and filed: \'1. Paducah Water Works Report - March, 1989 "2. Certificate of Insurance -- Paul Duncan Construction Company \13. Certificate of Insurance - Comcast Cablevision of Paducah Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro -tem Leeper ( 4) . Commissioner Leeper offered motion, seconded by Commissioner Keeling, that the Board of Commissioners approve the sale of the following cemetery lot(s) and that the City Clerk be authorized to execute a Deed of Conveyance for said cemetery grave(s): 1. Mae Howard, Rushing Addition to Oak Grove Cemetery, Sec. 6, Lot 145 NE, in the amount of $150.00 (Receipt No. 56849) Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Coleman offered motion, seconded by Commissioner Grumley, that upon the recommendation of the City Manager, the Board of Conunissioners of the City of Paducah orders that the personnel changes on the attached list be approved. Adopted on call of the roll, yeas, Commissioners Coleman, Grw-nley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Keeling offered motion, seconded by Commissioner Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR RESURFACING VARIOUS STREETS IN THE CITY OF PADUCAH", be adopted. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Leeper offered motion, seconded by Commissioner Keeling, that that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE PURCHASE OF THE CITY'S REQUIREMENT OF ASPHALT (EITHER LIQUID OR EMULSIFIED, OR BOTH) FOR THE YEAR 1989-90, TO BE USED IN STREET CONSTRUCTION AND REPAIR WORK", be adopted. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Coleman offered motion, seconded by Commissioner Grumley, that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE PURCHASE OF THE CITY'S REQUIREMENT OF LIMESTONE FOR THE YEAR 1989-90 (APPROXIMATELY 3,000 TONS) TO BE USED IN STREET CONSTRUCTION", be adopted. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Grumley offered motion, seconded by Commissioner Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE PURCHASE OF THE CITY'S REQUIREMENT OF BITUMINOUS CONCRETE (CLASS I, TYPE A) FOR THE YEAR 1989-90 (APPROXIMATELY 1,000 TONS) TO BE USED IN STREET MAINTENANCE", be adopted. Commissioner Keeling offered motion, seconded by Commissioner Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER ADOPTING AMENDMENT #2 OF THE ADMINISTRATIVE PLAN FOR SECTION 8 EXISTING HOUSING (REVISION NO. 4), STATEMENT OF PROGRAM APPROACH AND GENERAL STRATEGY, AS REQUIRED BY THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED" be adopted. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Keeling and Mayor Pro -tem Leeper (4). Commissioner Leeper offered motion, seconded by Commissioner Keeling, that that the Board of Commissioners .introduce and adopt an ordinance entitled, "AN ORD.TNANCE AUTHORIZING THE MAYOR AND CITY" CLERK TO ENTER INTO AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND CITIZENS BANK & TRUST COMPANY FOR THE CONSTRUCTION OF A COMMUNICATIONS CABLE ABOVE NORTH 4TH STREET". This ordinance is summarized as follows: Authorizing the Mayor and City Clerk to enter into an Encroachment Agreement with Citizens Bank & 'T'rust Company for the Proceedings of Board of Commissioners M City of Paducah construction of a communications cable above North 4th Street. Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "Ali ORDINANCE AUTHORIZING THE CITY TREASURER TO PAY MORRISON CONTRACTORS THE AMOUNT OF $10,635.00 FOR LANDFILL DIRT". This ordinance was read in full. Adopted on call of the roll, yeas, Commissioners, Coleman, Grumley, Keeling and Mayor Pro --tem Leeper (4). Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE ACCEPTING THE PROPOSAL OF D & D CONSTRUCTION COMPANY IN THE AMOUNT OF $3,778.00 FOR ROOF REPAIRS TO PARKS & RECREATION ADMINISTRATION BUILDING, AND AUTHORIZING THE CITY TREASURER TO PAY SAME". This ordinance is summarized as follows: Accepting the proposal of D & D Construction Company in the amount of $3,778.00 .for roof repairs to the Parks & Recreation Administrative Building, and authorizing the City Treasurer to pay same. Commissioner Keeling offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SUB -SECTION (A) OF SECTION 25--11 'NUMBER, RANK AND SALARIES OF MEMBERS OF THE POLICE DEPARTMENT' OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Amending salaries of command officers in the Police Department. Commissioner Leeper offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 88-6-4087 ENTITLED, 'AN ORDINANCE ADOPTING THE CITY OF PADUCAH, KENTUCKY ANNUAL BUDGET FOR THE FISCAL YEAR JULY 1, 1988, THROUGH JUNE 30, 1989, BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS FOR THE OPERATION OF CITY GOVERNMENT". This ordinance is summarized as follows: Increase budgetary appropriations for 911 Contribution to $228,000. Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 10-59, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,. KENTUCKY". This ordinance is summarized as follows: Creating one laborer position in the Parks Department. Commissioner Grumley offered motion, seconded by Commissioner Coleman that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE CREATING SECTION 7-8.0 THROUGH 7--8.11 OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH ESTABLISHING A PROCEDURE FOR PLANNED REDEVELOPMENT FOR THE DOWNTOWN COMMERCIAL DISTRICT LISTED ON THE NATIONAL REGISTER OF HISTORIC PLACES AND SETTING FORTH REQUIREMEN'T'S FOR :ISSUANCE OF A CERTIFICATE OF DEMOLITION". Commissioner Keeling offered motion, seconded by Commissioner Leeper, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE CITY TREASURER TO REIMBURSE COVER X CORPORATION THE AMOUNT OF $3,000.00 FOR DEDUCTIBLE CLAIM OF ESTATE OF SADIE KEMP". This ordinance is summarized as follows: Authorizing the City Treasurer to reimburse the amount of $3,000 to Cover X Corporation for deductible claim of Estate of Sadie Kemp. Commissioner Leeper offered motion, seconded by Commissioner Keeling, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE CITY TREASURER TO PAY THE SUFI OF $4,215.74 TO DENTON & KEULER FOR LEGAL SERVICES RENDERED TO THE CITY OF PADUCAH". This ordinance is summarized as follows: Authorizing the City Treasurer to pay the sum of $4,215.74 to Denton & Keuler for .legal services rendered to the City in the case of City v.
