Commission Chambers, City Hall, Paducah, Kentucky, at 6:00 p.m. on March 27, �I I ORKSIIOP Job Classification Hearings for: Terry Joe Keeling George Coleman \,f Executive Session Presentation of Awards to Dale Gentner Pat Earles Don Troendle \'Discussion by Mark Bryant re property rezoning in vicinity of 28th & Kentucky avenue `A Conunission's Request to Planning Commission to Reconsider its Decision on Rezoning Property at 28th & Kentucky Avenue 1990, Mayor Montgomery presided and upon call of the roll, the following answered to their names: Commissioners Coleman, Grumley, Leeper and Mayor Montgomery (4). Commissioner Taylor arrived at 7:30. The Board conducted a Workshop. Terry Joe Keeling and George Coleman had hearing before the Board concerning their appeal to the Clemans Nelson & Associates job classification and pay plan. Joe Wyatt questioned the recent placement of the Floodwall Department under the direction of the Sewer Works Director. Commissioner Leeper offered motion, seconded by Commissioner Grumley, that the Board of Commissioners go into Executive Session for discussions which might lead to the appointment, discipline or dismissal of an individual employee, and to discuss litigation. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper and Mayor Montgomery (4). At the conclusion of the Executive Session the Board reconvened in the Commission Chambers, whereupon the Mayor called the meeting back to order. Mayor Montgomery presented awards of recognition to Dale Gentner, Pat Earles and Don `1'roendle. Bank. Charles Koss reported on PADD activities and the Purchase Area Food Mark Bryant, Attorney, discussed rezoning of property located in the vicinity of 28th and Kentucky Avenue and requested that the Board of Commissioners resubmit this request to the Paducah Planning Commission for reconsideration of its previous decision denying the rezoning request. Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners request the Planning Commission to reconsider its decision on rezoning property located at 28th and Kentucky Avenue. Adopted on call of the roll, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the reading of the Minutes for March 13, 15, and 23, 1990, be waived and that the Minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the reading of the Minutes for February 27 and March 7, 1990, be waived and that the Minutes of said meeting prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Mayor Montgomery made the following appointment: "WHEREAS, the term of Mrs. Martha Dawson as a member of the Paducah Transit Authority expired on Proceedings of Board of Corrunissioners No. City of Paducah ,Tune 30, 1989, 1 hereby, subject to the approval of the Board of Commissioners, appoint Mondella Woods as a member of this :Board, which term will expire June 30, 1993." Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners approve the action of Mayor Montgomery is appointing Mondella Woods as a member of the Paducah Transit Authority. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Mayor Montgomery made the following appointment: "WHEREAS, subject to the approval of the Board of Commissioners, I hereby appoint James L. Mayer as a member of Paducah -McCracken County Senior Citizens, Inc. to replace Curtis Gamblin, who has died. This term will expire July 1, 1992." Commissioner Leeper offered motion, seconded by Commissioner Taylor, that the Board of Commissioners approve the action of Mayor Montgomery in appointing James L. Mayer as a member of Paducah -McCracken County Senior Citizens, Inc. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Taylor offered motion, seconded by Commissioner Leeper, that the following documents be received and filed: \'1. Paducah Water Works Report - February, 1990 2. Certificate of Insurance - W. Ky. Sprinkler Co. Inc. 3. Certificate of Insurance - Dale & Shirley Binford 4. Certificate of Insurance -- Sharon B. Sanderson 5. Letter of Agreement No. 4 to Service Service Agreement between City of Paducah & Sanitation District No. 2 6. Report of Planning & Zoning Commission on Rezoning Request for Property Located at Bleich Road & R.idgeview Street in Thompson Heights Subdivision 7. Report of Planning & Zoning Commission on Rezoning Request for Property Located at 2722, 2724, 2732 & 2736 Ky. Ave. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Coleman offered motion, seconded by Commissioner Grumley, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. (SEE MUNICIPAL ORDER BOOK) Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (.5). Mayor Montgomery offered motion, seconded by Commissioner Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER APPROVING THE APPLICATION FOR STATE ASSISTANCE UNDER THE KENTUCKY EMERGENCY SHELTER GRANTS PROGRAM THROUGH THE DEPARTMENT OF LOCAL GOVERNMENT, COMMONWEAL'T'H OF KENTUCKY, AND AUTHORIZING THE MAYOR TO EXECUTE SAID DOCUMENTS", be adopted. City of Paducah March 27, 1990 Commissioner Grumley offered motion, seconded by Commissioner Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER ADOPTING REVISION OF THE UTILITY ALLOWANCES FOR THE SECTION S HOUSING AND VOUCHER PROGRAM AS REQUIRED BY THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1914, AS REVISED", be adopted. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Leeper offered motion, seconded by Commissioner Taylor, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTIONS 10-49 AND 10--61, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Changing the title of computer operator to computer specialist and increasing the salary to $1,702 per month, and deleting old salaries in the Inspection Department. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Taylor offered motion, seconded by Commissioner Leeper, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SUBSECTION (A) OF SECTION 2x-47, NONCIVIL SERVICE GENERALLY, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Adding the position of temporary crew leader at a salary of $7.00 per hour. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE SETTING BOND AMOUNT FOR PHASE III OF THE FAIRFIELD SUBDIVISION". This ordinance is summarized as follows: Setting bond or approved letter of credit in the amount of $135,000 for Phase III of the Fairfield Subdivision, subject to the approval of the City Engineer and the Corporation Counsel for the City of Paducah. Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, 'AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT BETWEEN THE DEPARTMENT OF RURAL AND MUNICIPAL AID, COMMONWEALTH OF KENTUCKY, AND THE CITY OF PADUCAH, KENTUCKY, FOR MAIN'T'ENANCE, RECONSTRUCTION OR CONSTRUCTION OF CITY STREETS". This ordinance was read in full. Commissioner Taylor offered motion, seconded by Commissioner Leeper, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AU'T'HORIZING THE MAYOR TO EXECUTE AN AGREEMENT BETWEEN COMCAST CABLE OF PADUCAH, INC., A KENTUCKY CORPORATION ("COMCAST") AND THE CITY OF PADUCAH, A MUNICIPAL CORPORATION OF THE COMMONWEALTH OF KENTUCKY ("CITY"). This ordinance is summarized as follows: Authorizing the Mayor to execute an Agreement between Comcast Cable of Paducah, Inc. and the City of Paducah for cable tv services. Proceedings of Board of Comnissioners No. City of Paducah March 27, 1990 Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN SAID CORPORATE LIMITS". This ordinance is summarized as follows: Annexing unincorporated territory into the City of Paducah west of and adjacent to the present city limits, along Holt Road and U.S. Highway 60. Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN SAID CORPORATE LIMITS". This ordinance is summarized as follows: Annexing unincorporated territory into the City of Paducah south of and adjacent to the present city limits, along Berger Road. Commissioner Leeper offered motion, seconded by Commissioner Taylor, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE APPROVING THE CLOSING OF A PORTION OF SOUTH TWENTY-SECOND STREET LOCATED BETWEEN "B" AND "C" STREETS". This ordinance is si-umarized as follows: Authorizing the Corporation Counsel to institute and prosecute an action in McCracken Circuit Court for a judgment closing a portion of South 22nd Street between "B" and "C" Streets. Adopted on call of the roll, yeas, Commissioners Coleman, Gruinley, Leeper, Taylor and Mayor Montgomery Commissioner Taylor offered motion, seconded by Commissioner Leeperr, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE CLOSING OF AN ALLEY LOCATED ON THE EAST SIDE OF "C" STREET". This ordinance is summarized as follows: Authorizing the Corporation Counsel to institute and prosecute an action in McCracken Circuit Court for a judgment closing an alley located on the east side of "C" Street. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE DEDICATION OF AN ALLEY LOCATED ON THE EAST SIDE OF "C" STREET". This ordinance is summarized as follows: Dedicating an alley located on the east side of "C" Street. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE CLOSING OF AN ALLEY LOCATED ON THE SOUTH SIDE OF CLAY STREET BETWEEN 31ST AND 32ND STREETS". Commissioner Leeper offered motion, seconded by Commissioner Taylor, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 25--4(a), 'POLICE', OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Adopting Revision No. 4 to the Manual of Rules and Procedures of the Police Department. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Taylor offered motion, seconded by Commissioner Leeper, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SUBSECTION (a) OF SECTION 12-19, 'NUMBER, RANK AND SALARIES OF MEMBERS' OF ARTICLE II, 'FIRE DEPARTMENT', OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Clarifying the Title of Assistant Fire Chief. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH PECK FLANNERY GREAM WARREN INC. IN THE AMOUNT OF $15,000 FOR SEISMIC SAFETY EVALUATION OF MUNICIPAL BUILDINGS". This ordinance was read in full. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). Commissioner Gruniley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners go into Executive Session for discussions which might lead to the appointment, discipline or dismissal of an individual employee, and to discuss litigation. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Leeper, Taylor and Mayor Montgomery (5). At the conclusion of the Executive Session the Board held a Workshop.
