HomeMy WebLinkAbout2008-8-7451ORDINANCE NO. 2008-8-7451 AN ORDINANCE PROVIDING FOR THE CLOSING OF FLOURNOY STREET FROM NORTH 6TH STREET TO THE OHIO RIVER BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize the closing of Flournoy Street from North 6t' Street to the Ohio River, and being more particularly described as follows: A strip of land being 60 feet wide located between North 6t' Street and the waters of the Ohio River, known as Flournoy Street, Paducah, McCracken County, Kentucky, as dedicated by the plat in the deed of record Deed Book "O" Page 230 of the records of the McCracken County Court Clerk, and being more particularly described as follows: Beginning at the point of intersection of the northerly right of way line of North 6t` Street and the easterly right of way line of Flournoy Street, said point being located North 62' 04' 48" West a distance of 38.48 feet from a U.S. Army Corps of Engineers concrete monument set at the Paducah Floodwall centerline equation station 60+29.55; Thence, from the point of beginning and with the northerly right of way line of North 6t' Street, North 62' 04' 48" West a distance of 60.14 feet to a point in the westerly right of way line of Flournoy Street; Thence, with the westerly right of way line of Flournoy Street, North 31' 52' 10" East passing a concrete monument at 127.08 feet, passing an iron pin and surveyors cap at 327.08 feet, and passing an iron pin and surveyors cap at 1,370.57 feet, a total distance of 1,658.00 feet to a point in the Ohio River; Thence, South 58' 16' 00" East a distance of 60.00 feet to a point in the easterly right of way line of Flournoy Street; Thence, with the easterly right of way line of Flournoy Street, South 31' 52' 10" West passing an iron pin and surveyors cap at 276.25 feet, passing an iron pin and surveyors cap at 1,296.19 feet, and passing a concrete monument at 1,596.19 feet, a total distance of 1,654.00 feet back to the point of beginning; The above-described parcel contains 2.2810 acres more or less (99,360 sq. ft.). All bearings referred to are based on the Kentucky State Plane South Zone (NAD 1983) and were derived from the City of Paducah GIS monument system. All iron pins referred to in the above description are 18" long ''/z" ribbed steel rebar with a 1 ''/z" aluminum cap marked "F&H Engineers LS 2547". All concrete monuments referred to are 4" diameter x 36" long poured concrete in a PVC tube with the same iron pin and cap imbedded and formed into the monument. Prepared by and in accordance with a survey performed under the supervision of: Gerald M. Kight, Ky. Licensed Prof. Surveyor 2547 Florence & Hutcheson, Inc., 2550 Irvin Cobb Drive, Paducah, Ky. 42003 SECTION 2. In support of its decision to close the aforesaid public way, the Board of Commissioners hereby makes the following findings of fact: a. The City of Paducah is the owner of property abutting the public way that the Board of Commissioners has authorized to be closed and there will not be any utility easements retained across the closed right of way. b. On the 7th day of July, 2008, the Paducah Planning Commission of the City of Paducah adopted a resolution recommending to the Mayor and Board of Commissioners of the City of Paducah closure of the aforesaid public way. SECTION 3. All requirements of KRS 82.405(1) and (2) having been met, the Board of Commissioners of the City of Paducah hereby concludes that the aforesaid public way, as described above, should be closed in accordance with the provisions of KRS 82.405. -.-:-r-• - -u,. - --.-- i'-o:z' -°r-"'ii',-,-., �.-T I ....� .._ . ,..,. _....,..,. P=.=�'r' --7 SECTION 4. The Mayor is hereby authorized, empowered, and directed to execute a plat entitled "Closure of Flournoy Street from North 6`" Street to the Ohio River". SECTION 5.
