HomeMy WebLinkAbout91-2-456777 I ORDINANCE NO. 91-2-4567 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING PHASE I AND II OF OAK VIEW SUBDIVISION, LOCATED ON NORTH 32ND STREET, AND AC- CEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS' WHEREAS, the Paducah Planning Commission, at a meeting held on July 20, 1987, adopted as a preliminary report, a plat of the proposed subdivision, and by Resolution dated January 7, 1991, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of the public rights-of-way and easements shown thereon; and BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on January 7, 1991, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF CHARLES CLARK LOCATED ON NORTH 32ND STREET", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plats are entitled, "Phase I and Phase II, Oak View Subdivision", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public rights-of-way and public utility easements shown on said plat shall be, and they are hereby, accepted, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the con- struction, improving or maintaining of said right-of-way, that being a matter for separate consideration and action. 78 The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inopera- tive, ineffective or invalid for any cause, the deficiency ,�. br invalidity of such section, paragraph or provision shall S� not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provi- sions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof. GERRY B.
