HomeMy WebLinkAbout91-4-4603176 ORDINANCE NO. 91- 4-4603 ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A CERTAIN PERMANENT UTILITY EASEMENT ACROSS THE PARCEL OF REAL PROPERTY BELONGING TO THOMAS P. WATSON AND WIFE, CHARLOTTE E. WATSON, TO BE USED BY THE CITY OF PADUCAH, KENTUCKY, TO LAY, MAINTAIN, REPAIR AND REMOVE A GRAVITY SANITARY SEWER AND AUTHORIZING THE CONDEMNATION OF SAME. WHEREAS, a certain permanent utility easement across a parcel of real property owned by Thomas P. Watson and wife, Charlotte E. Watson, is necessary for the construction and maintenance of a gravity sanitary sewer by the City of Paducah, Kentucky; and WHEREAS, the following described real property is needed by the City of Paducah, Kentucky, in the furtherance of the public purpose of the City of Paducah to provide a clean and sanitary sewage disposal system; and WHEREAS, the City of Paducah, Kentucky, has been unable to contract or agree with the owners thereof for the acquisition or purchase of the real property sought to be condemned; and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, do hereby authorize the condemnation of an easement across the herein described real property pursuant to the Kentucky revised statute; Kentucky: NOW, THEREFORE, be it ordained by the City of Paducah, SECTION ONE That the corporate counsel of the City of Paducah, Kentucky, be and hereby is authorized and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City of Paducah, Kentucky, against Thomas P. Watson and wife, Charlotte E. Watson, and all other parties at interest to acquire the necessary easement rights across the subject property owned by the aforesaid persons. SECTION TWO That the easement to be acquired is in McCracken County, Kentucky, and is more particularly described as follows: C� T- Being a strip of land 20 feet in width as indicated on the attached drawing, the center line of said strip being more particularly described as follows: Beginning where the center line of the herein described parcel intersects the grantor's easterly property line, said point of intersection being located S. 150-28'-01" W., 217.71 feet from the grantor's northeasterly property corner as measured along said easterly property line; thence S. 720-51'-34" W., 836.72 feet; thence S. 260-50'-04" W., 738.69 feet to a point, thence N. 710-32'-07" W., 69.06 feet to the grantor's westerly property line, the termination point of the herein described parcel, said point being located N. 180-27'-53" E. a distance of 209.9 feet from a 4" x 4" concrete monument located at the northwesterly corner of the John Hailey property of record in Deed Book 410, page 180 of the McCracken County Court Clerk's Office. A plat of the aforesaid easement is attached hereto and made a part hereof as Exhibit "A". SECTION THREE This ordinance shall be read on two separate days and will become effective upon publication of the title and a certified summary thereof. GERR B.
