HomeMy WebLinkAbout91-4-4602174 ORDINANCE NO. 91- 4-4602 ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A CERTAIN PERMANENT UTILITY EASEMENT ACROSS THE PARCEL OF REAL PROPERTY BELONGING TO MARY WILLIAMS, ET AL, TO BE USED BY THE CITY OF PADUCAH, KENTUCKY, TO LAY, MAINTAIN, REPAIR AND REMOVE A GRAVITY SANITARY SEWER AND AUTHORIZING THE CONDEMNATION OF SAME. WHEREAS, a certain permanent utility easement across a parcel of real property owned by Mary Williams, et al, is necessary for the construction and maintenance of a gravity \ sanitary sewer by the City of Paducah, Kentucky; and �r WHEREAS, the following described real property is needed by the City of Paducah, Kentucky, in the furtherance of the public purpose of the City of Paducah to provide a clean and sanitary sewage disposal system; and WHEREAS, the City of Paducah, Kentucky, has been unable to contract or agree with the owners thereof for the acquisition or purchase of the real property sought to be condemned; and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, do hereby authorize the condemnation of an easement across the herein described real property pursuant to the Kentucky revised statute; NOW, THEREFORE, be it ordained by the City of Paducah, Kentucky: SECTION ONE That the corporate counsel of the City of Paducah, Kentucky, be and hereby is authorized and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City of Paducah, Kentucky, against Mary Williams and all other parties at interest to acquire the necessary easement rights across the subject property owned by the aforesaid persons. SECTION TWO That the easement to be acquired is in McCracken County, Kentucky, and is more particularly described as follows: Being a strip of land 25 feet in width along the south property line and 20 feet in width along the east property line of the Grantor's land as indicated on the attached drawing, more particularly described as follows: Beginning at the Grantor's southwest property corner, said corner being on the east right- of-way line of the Holt Road, 15 feet from the center line thereof; thence S. 860-371- 11" E. along and with the Grantor's south line 636.75 feet to Grantor's southeast corner; thence N. 200-22'-49" E. along and with Grantor's east property line 400.00 feet; thence in a westerly direction at right angles to said east line, 20.0 feet; thence S. 200-22'-49" W. along a line 20.0 feet west of and parallel with Grantor's east line to a point located 25 feet from and perpendicular to the aforesaid south line of said Grantor's property; thence N. 860-37'-11" W. along a line 25 feet north of and parallel with Grantor's south property line to the east right-of-way line of Holt Road; thence in a southerly direction with said right-of-way line, 25 feet, more or less, to the point of beginning and containing 23,420 square feet, more or less, or 0.538 acre, more or less. A plat of the aforesaid easement is attached hereto and made a part hereof as Exhibit "A". SECTION THREE This ordinance shall be read on two separate days and will become effective upon publication of the title and a certified summary thereof. GERR B.
