HomeMy WebLinkAbout91-10-4683328 ORDINANCE NO. 91-10-4683 AN ORDINANCE CLOSING A PORTION OF SOUTH CENTRAL AVENUE LOCATED ON THE WESTERLY SIDE OF COUNTRY CLUB LANE AND THE EASTERLY LINE OF SOUTH CENTRAL AVENUE WHEREAS, Daniel and Janice Howard have requested that a portion of the right-of-way known as South Central Avenue be closed; and WHEREAS, the Planning Commission approved this closing on September 16, 1991; and WHEREAS, the Board of Commissioners finds that this right-of-way is unimproved and is not needed as a public right-of-way; and BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize the closing of a portion of South Central Avenue on the westerly side of Country Club Lane and the easterly line of a 20 foot wide alley and known as a portion of South Central Avenue, which is more particularly described as follows: Beginning at a 4" x 4" stone monument found where the westerly right-of-way line of Country Club Lane intersects the northerly right-of-way line of South Central Avenue, said monument being situated at the southeasterly corner of Lot Number One, Block "E", of the aforesaid addition to the City of Paducah and also being the easterly most corner of Lot "A" as shown by plat of record in Plat Section "K", page 119 of the aforesaid Clerk's Office; thence south 39 degrees 39 minutes 30 seconds east along and with the westerly right-of- way line of Country Club Lane, 56.64 feet to the point of intersection of the center line of South Central Avenue; thence south 39 degrees 30 minutes 15 seconds east continuing with the aforesaid westerly right-of-way line, 56.65 feet to the northeasterly corner of lot Number 14, Block "G", of the aforesaid addition to the City of Paducah; thence south 22 degrees 19 minutes 00 seconds west along and with the northerly line of said lot and the southerly right-of-way line of said South Central Avenue, 226.61 feet (226.2 feet by the plat of the aforesaid addition) to the easterly right-of-way line of a 20 foot wide unimproved alley; thence north 39 degrees 38 minutes 15 seconds west with a projection of said easterly right-of-way line, 113.31 feet to the point of intersection with the southerly line of Lot Number 5, Block "E" of the aforesaid addition, said point of intersection being located south 22 degrees 19 minutes 00 seconds west a distance of 6.05 feet from a one-half inch steel rod situated at the southeasterly corner of said lot; thence north 22 degrees 19 minutes 00 seconds east along and with the southerly line of said Block "E" and the northerly right-of-way line of said South Central Avenue, 226.59 feet to the point of beginning and containing 22,660 square feet or 0.520 acre and being subject to a 15 foot wide sanitary sewer easement reserved for an existing 8 inch sanitary sewer, the northerly line of said easement being located 35 feet south of and running parallel with the northerly line of the herein described property, said 0.520 acre parcel also being subject to another 15 foot wide utility easement reserved for an existing 2 inch high pressure gas main and an overhead cable TV line, the southerly line of said easement being located 15 feet south of and running parallel with the northerly line of the herein described property. SECTION 2. The City is approving the closing of the right-of-way contingent upon the adjoining property owners granting to the City a permanent utility easement thereon, over and under the right-of-way being closed. SECTION 3. The Corporation Counsel of the City of Paducah, Kentucky, is hereby authorized, empowered and directed to institute and prosecute, pursuant to KRS 82.405, an action in McCracken Circuit Court for a judgment ordering the closing of the street described in Section 1 above. SECTION 4. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. GERRY B.
