HomeMy WebLinkAbout91-6-4625221 ORDINANCE NO. 91-6-4625 AN ORDINANCE IMPOSING A FEE TO BE PAID BY LOCAL TELEPHONE EXCHANGE SUBSCRIBERS OF ONE DOLLAR ($1.00) PER MONTH PER LINE, PROVIDING FOR THE MANNER OF COLLECTION OF SUCH FEE, AND PAYMENT OF FEE BY TELEPHONE COMPANIES TO THE PADUCAH-MCCRACKEN COUNTY EMERGENCY COMMUNICATION SERVICE BOARD, AND REPEALING SECTIONS 2-410 THROUGH SECTION 2-420 OF CHAPTER 2, (EMERGENCY COMMUNICATIONS BOARD) OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH. WHEREAS, KRS 65-750 allows the City of Paducah and McCracken County to enter into an Interlocal Cooperation Agreement for the establishment of an enhanced 911 emergency telephone system; and WHEREAS, KRS 65.760(2) provides for the City and/or County to levy any special tax, license, or fee to establish and operate and enhance 911 emergency telephone system; and WHEREAS, the Fiscal Court of McCracken County and the Board of Commissioners of the City of Paducah have established an enhanced 911 emergency telephone system, pursuant to KRS 65.250(2)(a). BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY, AS FOLLOWS: SECTION 1. Funding for the enhanced 911 emergency telephone system shall be administered by The Paducah - McCracken County Emergency Communication Service Board composed of a County Commissioner, a City Commissioner, an individual appointed by the County Judge/Executive, an individual appointed by the Mayor, and an individual appointed jointly by the County Judge/Executive and the Mayor. SECTION 2. The telephone companies providing service to subscribers in the City of Paducah shall collect for each line within the City of Paducah the sum of one dollar ($1.00) per month. SECTION 3. The telephone companies shall turn said sums over to The Paducah -McCracken County Emergency Communication Service Board within ten (10) days after the end of each month, who shall put said sums into an account which shall be used only for the purchase of equipment for the system and/or operating expenses of said system. The monies so deposited shall not be used for any other purpose. SECTION 4. The cost of the operation of the enhanced 911 emergency telephone shall be apportioned among the City of Paducah and McCracken County, Kentucky, according to the Interlocal Cooperation Agreement. SECTION 5. This ordinance hereby repeals Sections 2-410 through Section 2-420 of Chapter 2 of the Paducah Code of Ordinances. In lieu thereof, this ordinance and Ordinance No. 91-5-4613 shall control. SECTION 6. This ordinance shall become effective upon passage by the Board of Commissioners upon two readings and being published in the newspaper. The fee shall be effective beginning with the July 1, 1991, telephone company billing cycle. GERRY B.
