ORDINANCE NO. 83-3-4035
AN ORDINANCE APPROVING AN AMENDMENT TO THE FRANCHISE
AGREEMENT BETWEEN THE CITY OF PADUCAH AND CARLTON WATKINS, DBA FUNLAND
WHEREAS, the City of Paducah and. Carlton Watkins entered into
a Franchise Agreement on the 28th day of March 1970, for the operation
of amusement rides in Noble Park within the City of Paducah; and
WHEREAS, Section 2 of said franchise provides that Carlton
Watkins is to provide liability insurance protecting the City of
Paducah in the amount of $100,000 per person and $300,000 per
occurrence for personal injury and $5,000 for property damage per
occurrence; and
WHEREAS, the cost of obtaining liability insurance has become
excessive; and
WHEREAS, in 1986 the Commonwealth of Kentucky adopted KRS
247.232 through 237.236, regulating amusement rides and attractions;
and
WHEREAS, KRS 247.234(c) provides among other things if the
"amusement ride or amusement attraction is permanently located or
erected on a site in this state, the applicant shall be required only
to provide proof of liability insurance in the sum of $100,000 or proof
of financial responsibility in the sum of $100,000; and
WHEREAS, the Board of Commissioners believes that the
protection set forth in KRS 247.234 is adequate to provide protection
for the City and patrons.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Board of Commissioners hereby approves
and authorizes the Mayor to enter into the Franchise Amendment with
Carlton Watkins, attached hereto as if set out in full.
SECTION 2. This ordinance shall be read on two separate days
