AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND TIM
ATKINSON
� WHEREAS, Tim Atkinson is the owner of certain real property

located at 142 and 146 Nolan Drive, Paducah, Kentucky; and
WHEREAS, the real estate located at 142 and 146 Nolan Drive
is located along and adjacent to the easterly right-of-way line of
Nolan Drive, which is a 30 -foot publicly dedicated street; and
WHEREAS, Nolan Drive, as dedicated, provides access to the
above-described tract of property from Nolan Drive; which access is
beneficial to said tract of real property; and
WHEREAS, Tim Atkinson has requested the Board of
Commissioners to formally approve the use of the above-mentioned
unimproved street adjoining 142 and 146 Nolan Drive as a private
driveway; and
WHEREAS, the parties have come to an agreement regarding the
� above -recited premises, anddo now de'sire:to formalize this agreement.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is authorized to enter into an
encroachment agreement with Tim Atkinson to use a 30 -foot portion of a
street right-of-way for a private driveway adjacent to 142 and 146
Nolan Drive., Paducah, Kentucky.
SECTION 2. The agreement between the City of Paducah and
Tim Atkinson is attached hereto and incorporated by reference herein as
if set out in full.
SECTION 3. This ordinance shall be read on two separate days
and will become effective upon publication of title and a certified
summary thereof.
