ORDINANCE NO. 89-11-4346
AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK
TO ENTER INTO AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF
PADUCAH, KENTUCKY, AND WAGNER MOVING & STORAGE, INC. FOR
ENCROACHMENTS UPON CITY RIGHT-OF-WAY AT 900 OLIVE STREET
WHEREAS, Wagner Moving & Storage, Inc. is the
owner of certain real property located at 900 Olive Street;
and
WHEREAS, Wagner Moving & Storage, Inc. has
requested from the City of Paducah permission to use a
portion of City right-of-way for the construction of
utility lines and light fixtures at the northern most end
of Fern Street and in a portion of an alley between Olive
Street and Ellis Street which abuts Wagner's property.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY
SECTION 1. That the Mayor be authorized to enter
into a temporary Encroachment'Agreement with Wagner Moving
& Storage, Inc. for the construction of utility lines and

light fixtures on City right-of-way at 900 Olive Street.
SECTION 2. Said Agreement is attached hereto and
incorporated by reference as if fully set out herein.
SECTION 3. This ordinance shall be read on two
separate days and will become effective upon publication of
title and a certified summary thereof.
