ORDINANCE NO. 89-6-4248
AN ORDINANCE APPROVING THE CLOSING OF A PORTION OF
ELIZABETH STREET LOCATED BETWEEN SOUTH THIRD STREET AND THE
FLOODWALL
WHEREAS, ITAPCO has requested that a portion of
the right-of-way known as Elizabeth Street be closed; and
WHEREAS, the Planning Commission approved this
closing on March 20, 1989; and
WHEREAS, the Board of Commissioners finds that
this right-of-way is unimproved and is not needed as a
public right-of-way.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City of Paducah does hereby
authorize the closing of a portion of Elizabeth Street,
located between South Third Street and the floodwall, which
is more particularly described as follows:
Beginning at a point in the northerly right-of-way
\� line of Elizabeth Street, said point being found
65' from the intersection of the northerly
right-of-way line of Elizabeth Street with the
easterly right-of-way line of Third Street; thence
with the northerly right-of-way line of Elizabeth
Street, in an easterly direction, 75' to a point
in the centerline of the floodwall; thence at a
right angle to Elizabeth Street, in a southerly
direction 66' to a point in the southerly
right-of-way line of Elizabeth Street; thence with
the southerly right-of-way line of Elizabeth
Street, in a westerly direction, 75' to a point;
thence at a right angle to Elizabeth Street, in a
northerly direction 66' to the point of beginning
and containing 4950 square feet as determined by
V.E. Newberry Ky. R.L.S. 2844, April 28, 1989.
SECTION 2. The City of Paducah is approving the
closing of the right-of-way contingent upon the adjoining
property owners granting to the City a permanent utility
easement thereon, over and under the right-of-way being
closed.
SECTION 3.
The Corporation Counsel of the City of
Paducah is hereby authorized, empowered and directed to
institute and prosecute, pursuant to KRS 82.405, an action
in McCracken Circuit Court for a judgment ordering the
closing of the street described in Section 1 above.

SECTION 4. This ordinance shall be read on two
separate days and will become effective upon publication of
title and a certified summary thereof.
