HomeMy WebLinkAbout89-2-4206524 ORDINANCE NO. 89-2-4206 AN ORDINANCE REVERSING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY LOCATED ON THE EAST SIDE OF METCALF LANE, AND DIRECTING AN AMENDMENT TO THE PADUCAH ZONING ORDINANCE -1976, SO AS TO CHANGE THE ZONE CLASSIFICATION FROM R-3, MEDIUM DENSITY RESIDENTIAL ZONE, TO B-3, GENERAL BUSINESS ZONE WHEREAS, the Paducah Planning Commission at a Public Hearing held on December 5, 1988, considered a proposal to amend the Paducah Zoning Ordinance - 1976, so as to change the zone classification of certain property located on the east side of Metcalf Lane from R-3, Medium Density Residential Zone, to B-3, General Business Zone; and WHEREAS, the aforesaid proposal was not approved by the Paducah Planning Commission; and WHEREAS, after considering the evidence submitted and being thoroughly advised in the premises, the Board of Commissioners does by this ordinance overrule and reverse the action of the Paducah Planning Commission. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Board of Commissioners finds, relative to the proposed amendment, as follows: 1. There has been a substantial change in the neighborhood by the rezoning of adjoining property and the construction of the racetrack and related facilities. 2. The present R-3 Zone consists of a small island in a large B-3 tract of land which would deprive the property owner of uses of his property which are available to a great number of surrounding property owners. 3. The development of the racetrack and other businesses in the area makes the property unsuitable for residential development, and the property owner would be deprived of any economic use of his property if the zoning request is not granted. 525 SECTION 3. That the Paducah Zoning Ordinance -1976, be amended so as to change the zone classification for the following property from R-3, Medium Density Residential Zone, to B-3, General Business Zone: Beginning at a point where the southerly line of the herein described property intersects the easterly right-of-way line of Metcalf Lane, said point being the northwest corner of the property described in Deed Book 704, page 398 of the McCracken County Clerk's Office, said point being further described as being located 515.13 feet, more or less, north of the relocated center line of U.S. Highway 60, as measured along said easterly right-of-way line of Metcalf Lane, 20 feet east of the center line thereof; thence from the point of beginning and with said easterly right-of-way line a distance of 416.50 feet to the southwest corner of the Crosthwaite.property; thence with Crosthwaite's south line a distance of 315 feet to the westerly line of the property known as Bluegrass Downs of Paducah, Inc.; thence south along and with the westerly line of said property 416 feet to the southwest corner of the property; thence north along and -with the southerly line of said property, 315 feet to the point of beginning. SECTION 3. That if any section, paragraph, or provision of this ordinance shall be found to be Cinoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separate from all other sections, paragraphs and provisions. SECTION 4. This ordinance shall be read on two separate days and shall be in full force and effect from and after its adoption. GERRY B.
