HomeMy WebLinkAbout92-6-4782N ORDINANCE NO. 92-6-4782 AN ORDINANCE FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS EPITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY 0 TY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract or property adjacent to the present city limits, located between U.S. Highway 60 and the Paducah Information Age Park, is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous -to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, KRS 81A.412 provides that a city may annex any area which meets the necessary requirements if each of the owners of record of such land consent in writing to the annexation; and WHEREAS, the owners have requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the annexation of the hereinafter described property, and therefore that the hereinafter described property be annexed to, and be made a part of the City of Paducah, Kentucky; said real property being more particularly and accurately described as follows: A parcel of land located on the south side of U.S. Highway 60, approximately 2.68 miles west along said Highway 60 from its intersection with Interstate Highway 24, McCracken County, Kentucky, and being more particularly described as follows: Beginning at an iron pin set at the northeast corner of the lands now or formerly owned by James D. Campbell (Deed Book 644, page 715), in the south right of way line of U.S. Highway 60, said iron pin being located 1109.5 feet west along U.S. Highway 60 from the west end of a concrete bridge over the Middle Fork of the Massac Creek; thence from the point of beginning and with the south right of way line of U.S. Highway 60, north 70 degrees 29 minutes 49 seconds east a distance of 1180.45 feet to a steel R post set in the flow line of the Middle Fork of the -- Massac Creek; thence with a line common to properties owned by Tommy Overstreet (Deed Book 641, page 100), George Lankton (Deed Book 607, page 794, and Deed Book 646, page 312), and Mike J. Streetman (Deed Book 729, page 97), south 10 degrees 38 minutes 12 seconds west a distance of 1711.74 feet to an iron pin set at the southwest corner of said Streetman property in the north line of the lands now or formerly owned by 549 Charles Williams (Deed Book 547, page 325); thence with the north line of said Williams property north 73 degrees 22 minutes 18 seconds west a distance of 177.25 feet to a concrete monument; thence with the west line of said Williams property south 19 degrees 29 minutes 45 seconds west a distance of 678.84 feet to a concrete monument; thence with a new line north 19 degrees 17 minutes 33 seconds west a distance of 1418.43 feet to a steel post found at the southwest corner of the James D. Campbell property; thence with the south line of said James D. Campbell property north 71 degrees 02 minutes 11 seconds east a distance of 242.36 feet to a steel post; thence north 19 degrees 17 minutes 19 seconds west a distance of 487.23 feet back to the point of beginning. This property is also known as Tract B, as shown on a plat filed in Plat Book K, page 304, in the office of the McCracken County Clerk. The above described parcel of land contains 32.5194 acres and is subject to a 150 foot wide easement granted in favor of Kentucky Utilities, and is subject to an unrecorded easement to Jackson Purchase Electric Cooperative Corporation. SECTION 2. This ordinance of annexation shall be read on two separate days and upon publication the territory described above shall become a part of the City of Paducah, Kentucky, for all purposes.
