AN ORDINANCE DENYING, IN PART, THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED
ON NORTH 10TH STREET BETWEEN H.C. MATHIS DRIVE AND COLE STREET
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
WHEREAS, the Board of Commissioners of the City of
Paducah has been informed that Distributors Warehouse, Inc., has
declined to execute a site development plan as required by the
Planning Commission in action hereafter described, the following
Ordinance is therefore adopted.
SECTION 1. That a resolution passed by the Paducah
Planning Commission on January 6, 1992, and readopted by said
Commission on February 3, 1992, and entitled "A RESOLUTION
CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION
ON THE PROPOSED REZONING OF PROPERTY LOCATED ON NORTH 10TH STREET
BETWEEN H.C. MATHIS DRIVE AND COLE STREET," be denied insofar as
it relates to property owned by Distributors Warehouse, Inc.,
located at 1900 North 10th Street, Paducah, Kentucky, and more
particularly described in Deed book 509, page 170, and being
--✓ known as Lot No. 3 of Record in Plat Book G, page 391, in the
office of the Clerk of the County Court of McCracken County,
Kentucky.
SECTION 2. The zone classification of the hereinbefore
described property remain M-1, Light Industrial Zone.
SECTION 3. That if any section, paragraph, or
provision of this Ordinance shall be found to be inoperative,
ineffective, or invalid for any cause, the deficiency or
invalidity of such section, paragraph, or provision shall not
effect any other section, paragraph, or provision hereof, it
being the purpose and intent of this Ordinance to make each and
every section, paragraph, and provision hereof separable from all
other sections, paragraphs, and provisions.
SECTION 4. This Ordinance shall be read on two
separate days and will become effective upon summary publication
pursuant to KRS Chapter 424.
