HomeMy WebLinkAbout92-3-4743458 ORDINANCE NO. 92-3-4743 AN ORDINANCE APPROVING, IN PART, THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED ON NORTH 10TH STREET BETWEEN H.C. MATHIS DRIVE AND COLE STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on January 6, 1992, and readopted by said Commission on February 3, 1992, and entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY LOCATED ON NORTH 10TH STREET BETWEEN H.C. MATHIS DRIVE AND COLE STREET," be approved as the final report of said Commission as it relates to property owned by Wagner Enterprises, Inc., at 1960 North 10th Street, Paducah, Kentucky. Said report, with a copy of the site development plan and a copy of the Agreement and Memorandum Effecting Real Property executed between Wagner Enterprises, Inc., and Roger Colburn, City Engineer, attached hereto, are final and binding respecting the matters therein set forth. SECTION 2. The zone classification and map amendment proposed in said resolution be, and the same are, hereby declared to be in agreement with the comprehensive plan of the City of Paducah, as it relates to property owned by Wagner Enterprises, Inc. SECTION 3. That the zone classification of the property owned by Wagner Enterprises, Inc., at 1960 North 10th Street, Paducah, Kentucky, and more particularly described in Deed Book 751, page 783, of the office of the Clerk of the County Court of McCracken County, Kentucky, is hereby changed from M-1, Light Industrial Zone, to M-3, High Density Industrial Zone. SECTION 4. That if any section, paragraph, or provision of this Ordinance shall be found to be inoperative, ineffective, or invalid for any cause, the deficiency or invalidity of such section, paragraph, or provision shall not effect any other section, paragraph, or provision hereof, it being the purpose and intent of this Ordinance to make each and C every section, paragraph, and provision hereof separable from all s other sections, paragraphs, and provisions. sions.
