HomeMy WebLinkAbout92-3-4736444 ORDINANCE NO. 92-3-4736 AN ORDINANCE ESTABLISHING THE AMOUNT TO BE CHARGED FOR CONNECTING TO CITY SANITARY SEWERS BY THE STINESPRING ESTATES SUBDIVISION AND PROVIDING FOR THE ISSUANCE OF CONNECTION PERMITS, PROVIDING FOR THR PAYMENT OF CONNECTION CHARGES AND PROVIDING PENALTIES FOR VIOLATION OF THE PROVISIONS HEREOF WHEREAS, on March 12, 1991, the City of Paducah entered into a sewer agreement with Theodore Herpel and his wife, Mary Agnes Herpel and Herpel Enterprises, Inc., regarding the City's annexation of the Herpel sanitation sewage connector line which would provide sanitation sewage services to the Herpel property; and WHEREAS, by Ordinance No. 91-11-4700 the Mayor was authorized to execute an Amended Sewer Agreement with Theodore Herpel and his wife, Mary Agnes Herpel and Herpel Enterprises, Inc. establishing conditions for the Stinespring Estates Subdivision's connection fee; and BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The charge for connecting any sewer constructed in conjunction with the Stinespring Estates Subdivision, is established as follows: A. Connection Charges. (1) The charge for connecting a single family residence or church to any of the sewers constructed in conjunction with the Stinespring Estates Subdivision is established at $1,025.00 for each individual lot. A separate fee shall be paid for each establishment and for each individual lot regardless of whether the connection to the sewer system is by individual service line or shared service line. (2) The charge for connecting a commercial establishment or multi -family residence to any sanitary sewer constructed in conjunction with the Stinespring Estates Subdivision is established at $1,025.00 for each individual lot. A separate fee shall be paid for each establishment and for each individual lot regardless of whether the connection to the sewer system is by individual service line or shared service line. m, d»err-i' ,� . �.. �_r 44 = _ M. 445 B. Service Lines. All costs for service lines including but not limited to boring or trenching (whether on or off of the right of way or easement) shall be paid for by the person connecting to the sewer system. SECTION 2. No connection to said sanitary sewer system shall be made by any property owner or other person, firm or corporation, except under permit for such connection issued by the City Engineering office of the City. SECTION 3. The City Engineering office shall not issue a connection permit set out in Section 2 hereof until the proper connection fee has been paid to the City Engineering office. SECTION 4. It shall be unlawful for any person, firm or corporation to fail to make the connection required by Section 33-4 of the Code of Ordinances of the City of Paducah to the sanitary sewer construction in the above described territory. SECTION 5. All ordinances or part of ordinances in conflict herewith, are to the extent of such conflict, hereby repealed. SECTION 6. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. D. ---4 G Y B.
