AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A SEWER
AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND KENNETH H.
MERGES AND HIS WIFE, HELEN F. MERGES; AND RAYMOND L. FRANKLIN AND
HIS WIFE, WANDA LEE FRANKLIN
WHEREAS, the Mergeses have acquired through contract
for deed from the Franklins a 26.1 acre tract of real property
located in McCracken County; and
WHEREAS, Merges utilizes the tract of real property as
a mobile home court known as Saxony Mobile Home Court; and
WHEREAS, the Kentucky Department for Environmental
Protection Division of Water has denied reissuance of the
Kentucky Pollutant Discharge Elimination System (KPDES) permit
for Saxony Mobile Home Court due to a provision to connect the
discharge to a comprehensive sewer system when available; and
WHEREAS, the City of Paducah now owns the sanitary
sewer extension that is located in the vicinity; and
WHEREAS Merges has requested that the Cit
g qu y provide
such sanitation services to the Saxony Mobile Home Park; and
WHEREAS, pursuant to ordinance, Merges may only obtain
City sanitation sewage services if and only if Saxony Mobile Home
Court is annexed to the City so as to become a part thereof; and
WHEREAS, the City is agreeable to providing such
sanitation services to Saxony Mobile Home Court provided that the
City be permitted to annex Saxony Mobile Home Court in the
future, and additionally, that Merges agrees to the terms and
provisions set forth in the Agreement, all of which conditions
are acceptable to Merges.
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is authorized to execute an
Agreement between the City of Paducah and Kenneth H. Merges and
wife, Helen F. Merges and Raymond L. Franklin and wife, Wanda Lee
Franklin. This Agreement is attached hereto and incorporated by
reference as if fully set out herein.
SECTION 2. This Ordinance shall be read on two

separate days and will become effective upon summary publication
pursuant to KRS Chapter 424.
