HomeMy WebLinkAbout92-10-4709M ORDINANCE NO. 92-1-4709 AN ORDINANCE AMENDING SECTION 12.0 OF CHAPTER 12, FIRE PREVENTION AND PROTECTION, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY WHEREAS, the City of Paducah adopted the Kentucky Standards of Safety (Fire Prevention Code 1990); and J WHEREAS, KRS 227.320 requires each local government unit to adopt and enforce the Kentucky Standards of Safety by ordinance; and WHEREAS, the Commissioner of the Department of Housing, Building & Construction has promulgated reasonable regulations setting minimum fire safety standards for Kentucky J in 815 Kentucky Administrative Regulation 10:040, which are known as the Kentucky Standards of Safety (Fire Prevention Code 1990). follows: BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. Adoption of the Kentucky Standards of Safety (Fire Prevention Code) "The Kentucky Standards of Safety (Fire Prevention Code) as promulgated in 815 KAR 10:040 by Commissioner of the Department of Housing, Building.& Construction on the advice and recommendation of the State Fire Marshal, is hereby adopted in full as an ordinance of the City of Paducah of the Commonwealth of Kentucky, and a certain document, one copy which is on file in the office of the City Clerk of the City of Paducah being marked and designated as 'The Kentucky Standards of Safety (Fire Prevention Code), First Edition 1990, as published by the Kentucky Department of Housing, Building & Construction"' SECTION 2. Sec. 12-0.1, Designated Enforcement Officer, is hereby created to read as follows: "The City Fire Marshal's Office shall be designated as the local enforcement agency for said standards of safety as appointed by the City." SECTION 3. Sec. 12-0.2, Stricter Provisions, is hereby created to read as follows: "Where stricter provisions provided for in current National Fire Prevention Codes are in conflict with this code, conflicts shall be resolved in favor of the stricter provi- sions, and where more liberal requirements are set forth throughout this code than are provided for in current National Fire Prevention Code Standards, the conflict shall be resolved in favor of the current National Fire Prevention Codes." SECTION 4. Sec. 12-0.3, Appeals Process, is hereby created to read as follows: "All final decisions of the Fire Code Official of the City of Paducah shall be appealable to a local appeals board pursuant to the procedures adopted by the City of Paducah." SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. 4GERRB.
