AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO
AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH,
KENTUCKY, AND THE MARKET HOUSE THEATRE FOR AN ENCROACHMENT
UPON CITY RIGHT-OF-WAY

WHEREAS, The Market House Theatre is the owner of
certain real property located at 132 South Second Street;
and
WHEREAS, The Market House Theatre has requested
from the City of Paducah permission to use a portion of
City right-of-way to complete various improvements to the
structure located at 132 South Second Street, which
improvements will encroach upon the City sidewalk. This
encroachment is insignificant in nature.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY
SECTION 1. The Mayor is hereby authorized to
enter into an Encroachment Agreement with The Market House
Theatre for completion of various improvements to the
structure located at 132 South Second Street, which
improvements will encroach upon the City right-of-way
(sidewalk) adjacent to this structure.
SECTION 2. Said Agreement is attached hereto and
incorporated by reference as if fully set out herein.
SECTION 3. This ordinance shall be read on two
separate days and will become effective upon summary
publication pursuant to KRS Chapter 424.
