HomeMy WebLinkAbout90-4-4404849 ORDINANCE NO. 90-4-4404 AN ORDINANCE APPROVING THE CLOSING OF A PORTION OF CHAMBLIN AVENUE LYING WEST OF IRVIN COBB DRIVE WHEREAS, the Planning Commission approved this closing on April 2, 1990; and WHEREAS, the Board of Commissioners finds that this right-of-way is unimproved and is not needed as a public right-of-way. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah does hereby authorize the closing of a portion of Chamblin Avenue lying west of Irvin Cobb Drive, which is more particularly described as follows: Beginning at a point in the south right-of-way line of Chamblin Avenue, said point being located in a westerly direction, 109.07 feet from the southwest intersection of the right-of-way lines of Chamblin Avenue and Irvin Cobb Drive; thence in a westerly direction and along the south right-of- way line of Chamblin Avenue 413.41 feet to a point marking the southeast intersection of the right- of-way lines of Chamblin Avenue and Hymarsh Avenue if extended; thence with an interior angle of 148 degrees 30 minutes and in a northerly direction and along the east right-of-way line of Hymarsh Avenue if extended, 95.69 feet to a point in the north right-of-way line of Chamblin Avenue; thence with an interior angle of 31 degrees 30 minutes and in an easterly direction and along the north right-of-way line of Chamblin Avenue, 495.0 feet to a point at the southeast corner of the Petty Oil Company property; thence with an interior angle of 90 degrees 00 minutes and in a southerly direction, 50.0 feet to the point of beginning. The first call and last call in the above descrip- tion make an interior angle of 90 degrees 00 minutes. Said tract contains 22,710.25 square feet or 0.521 acres. SECTION 2. The City is approving the closing of the right-of-way contingent upon the adjoining property owners granting to the City a permanent utility easement thereon, over and under the right-of-way being closed. SECTION 3. The Corporation Counsel of the City of Paducah is hereby authorized, empowered and directed to institute and prosecute, pursuant to KRS 82.405, an action 850 in McCracken Circuit Court for a judgment ordering the closing of the street described in Section 1 above. SECTION 4. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof. GERRY B.
