HomeMy WebLinkAbout90-4-4401845 ORDINANCE NO. 90-4-4401 AN ORDINANCE FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY, AND DEFINING ACCURATELY THE.BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract of property south of and adja- cent to the present city limits, along Berger Road, is urban in character and suitable for development for urban purposes without unreasonable delay. WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property. WHEREAS, said tract of land is not within the boundary of another incorporated city. WHEREAS, KRS 81A.412 provides that a city may annex any area which meets the necessary requirements if each of the owners of record of such land consent in writing to the annexation. WHEREAS, the owners have requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah. WHEREAS, the Board of Commissioners of the City of Paducah have enacted Ordinance 90-03-4383 expressing the intentions of the City of Paducah To annex and make a part of the City of Paducah the territory described below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the hereinafter described property be annexed to, and be made a part of, the City of Paducah, Kentucky; the said real property being more par- ticularly and accurately described as follows: Beginning at a point in the north right-of-way of Berger Road, said point being 695' more or less, east of the east right-of-way of Lone Oak Road (U.S. 45) and also being the point of intersection of said right-of-way and the east property line, if extended across Berger Road, :[A: of Lot "C" of "Subdivision - Plat of Additional Property on Berger Road at Lone Oak Road" as recorded in Plat Book "H", Page 682 in the McCracken County Court Clerk's office; thence in an easterly direction along the north right-of-way of Berger Road 100' more or less, to a point, said point being the point of inter- section of said right-of-way and the dividing line of said subdivision and J. Brandon Price properties, if extended across Berger Road; thence in an southerly direction, crossing Berger Road, and along the property line of J. Brandon Price 405' more or less, to a iron pipe, corner to Rankin (Fergerson); thence in a westerly direction 189' to a iron pipe, the southeast corner of Lot "H", as shown by said plat; thence in a northerly direction 151.08' to an iron pipe, the northeast corner of Lot "H"; thence in a easterly direction 71' to a iron pipe, the southeast corner of Lot "C", as shown by said plat; thence in a northerly direction along the east property line of Lot "C", if extended across Berger Road, 195' to the point of beginning. SECTION 2. This final ordinance of annexation shall be read on two separate days and upon publication the territory described above shall become a part of the City of Paducah, Kentucky for all purposes.
