ORDINANCE NO. 90-9-4498
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT BETWEEN COMCAST CABLE OF PADUCAH, INC. (A KENTUCKY
CORPORATION) AND THE CITY OF PADUCAH, KENTUCKY
WHEREAS, the City and Comcast are parties to a
cable television franchise dated April 19, 1975, which
franchise expired on April 18, 1990; and
WHEREAS, Comcast by letter dated September 29,
1987, invoked the provisions of the Cable Communications
Policy Act of 1984 governing the renewal of cable television
franchises, which provisions provide for minimum formal
procedures in the event the parties are unable to otherwise
agree on a franchise renewal; and
WHEREAS, in the spirit of cooperation the City and
Comcast have engaged in renewal discussions without recourse
to said formal procedures; and
WHEREAS, the parties have reached tentative
agreement on the terms of a franchise renewal; and
WHEREAS, it was not possible to complete the
renewal proceedings prior to April 18, 1990, and a
ninety day extension of the franchise agreement was entered
into by the City and Comcast; and
WHEREAS, an additional sixty day extension of the
franchise agreement was entered into by the City and
Comcast; and
WHEREAS, it was not possible to complete the
renewal proceedings prior to the previously extended expira-
tion date of September 15, 1990.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is authorized to
execute an Agreement between the City of Paducah and Comcast
Cable of Paducah, Inc., extending the franchise agreement an

additional one hundred twenty (120) days to January 14,
1991. This Agreement is attached hereto and incorporated by
reference as if fully set out herein.
SECTION 2. Since the present franchise agreement
expired September 15, 1990, an emergency is hereby declared
to exist and this ordinance will become effective immedi-
ately with one reading.
