HomeMy WebLinkAbout93-3-491882 ORDINANCE #93-3- 4918 AN ORDINANCE PROVIDING FOR THE CLOSING OF RAYMOND DRIVE, AN UNDEVELOPED STREET LOCATED IN JONQUILAWN SUBDIVISION, PADUCAH, KENTUCKY, AND RESERVING A PERMANENT UTILITY EASEMENT THEREON, OVER AND UNDER SAID RIGHT-OF-WAY WHEREAS, by action dated March 1, 1993, the Paducah Planning Commission adopted a resolution entitled A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED CLOSING OF RAYMOND DRIVE; and WHEREAS, by and through said resolution the Paducah Planning Commission has recommended to the Mayor and Board of Commissioners of the City of Paducah the proposal to close Raymond Drive; KENTUCKY: NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, SECTION 1. That the City of Paducah does hereby authorize the closing of Raymond Drive, an undeveloped street located in Jonquilawn Subdivision, Paducah, Kentucky, more particularly described as follows: Beginning at the Northwest intersection of the right of way lines of Raymond Drive and Martin Circle; thence, in a Northwesterly direction along the Westerly right of way line of Raymond Drive, 512.90 feet to a point; thence, with an interior angle of 1420 19' and in a Northerly direction 40.9 feet to a point; thence, with an interior angle of 690 56' and in an Easterly direction, 46.85 feet to a point in the Easterly right of way line of Raymond Drive; thence, with an interior angle of 1470 45' and in a Southeasterly direction along the Easterly right of way line of Raymond Drive, 504.20 feet to a point being the Northeast intersection of the right of way lines of Martin Circle and Raymond Drive; thence, with an interior angle of 910 40' and in a Southwesterly direction across the chord of a curve to the left, 50.02 feet, or for a distance of 50.07 feet around the arc of the curve to the point of beginning. The first call and last call in the above description make an interior angle of 880 201. Said parcel contains 26,294 square feet or 0.60 acres. Reference is hereby made to the plat of Jonquilawn Subdivision as recorded in Plat Section "G", at page 20. Section 2. Notwithstanding the foregoing, the City hereby reserves unto itself a permanent utility easement thereon, over, and under the right-of-way being closed, said easement being more particularly described as follows: Being a utility easement of 20 feet wide and being located 10 feet both sides of the centerline of what is now Raymond Drive. Said centerline being described as beginning at the point of intersection of centerline of Raymond Drive and the Northerly right of way of Martin Circle; thence, in a Northerly direction along the centerline of Raymond Drive a distance of 543.54 feet to the point of intersection of the centerline of Raymond Drive and the Northwest corner of the Jonquilawn Subdivision. Reference is hereby made to the plat of Jonquilawn Subdivision as recorded in Plat Section "G", page 20. SECTION 3. The Corporate Counsel of the City of Paducah, Kentucky, be and is hereby authorized, empowered, and directed to institute and prosecute pursuant to KRS 82.405 an action in the McCracken Circuit Court for a judgment ordering the closing of the street described in Section 1 above. SECTION 4. This ordinance will be read on two separate days and will become effective upon publication of title and a certified summary thereof.
