HomeMy WebLinkAbout93-1-4891ORDINANCE #93-1- q$9 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF MICHAEL FALCONITE LOCATED IN THE COLEMAN ROAD INDUSTRIAL PARK, LOCATED ON THE NORTH SIDE OF CHARTER OAK DRIVE, AND ACCEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS Planning Commission WHEREAS, the Paducah P g , at a meeting held December 7, 1992, adopted as a preliminary report, a plat of subdivision at the Coleman Road Industrial Park for Michael Falconite, and by resolution dated January 4, 1993, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of the public rights-of-way and easements shown thereon. THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on January 4, 1993, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF MICHAEL FALCONITE LOCATED IN THE COLEMAN ROAD INDUSTRIAL PARK" be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to for said subdivision, which plat is entitled "Plat of Subdivision at the Coleman Road Industrial Park for Michael Falconite," and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public \ rights-of-way and public utility easements shown on said plat shall be, and they are hereby, accepted, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the constructing, improving, or maintaining of said easements, that being a 23 v matter for separate consideration and action. The Mayor Pro Tem is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That if any section, paragraph, or provision of this ordinance shall be found to be inoperable, ineffective, or invalid for any cause, the deficiency or 1 invalidity of such section, paragraph, or provision shall not effect any other section, paragraph, or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph, and provision hereof separable from all other sections, paragraphs, and provisions. SECTION 5. This ordinance will be read on two separate days and will become effective upon publication of title and a certified summary thereof.
