AN ORDINANCE DECLARING THE INTENTION OF THE
CITY OF PADUCAH TO CONSTRUCT A PRIMARY ACCESS
ROAD ON OF THE WEST SIDE OF HOLT ROAD AS
SPECIFIED IN THE AMENDED HOLT ROAD
DEVELOPMENT PLAN.
WHEREAS, on November 23, 1992, the Paducah Planning Commission
did approve an Amended Development Plan for the development of various
properties at the intersection of U.S. Highway 60 and Holt Road; and
WHEREAS, the City of Paducah did approve the aforesaid Amended
Development Plan for the Holt Road Project on the 15th day of December, 1992;
and
WHEREAS, one of the conditions of the development plan was that an
access roadway be constructed by the City of Paducah on or across Lot 7 as
specified in the aforesaid development plan.
KENTUCKY:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
SECTION 1. That the City of Paducah, hereby formally declares its
intention to fully construct a primary access road on of the west side of Holt Road
and on or across Lot 7, all as required under the terms and conditions of the
Amended Development Plan for the Holt Road Project.
SECTION 2. That the subject primary access roadway will be built
according to the specifications and conditions as established by the City of
Paducah, Kentucky, and the Code of Ordinances of the City of Paducah and will
be constructed within one year from the passage of this ordinance.
SECTION 3. Each and every landowner subject to the Amended
Development Plan for the Holt Road Project, and their assigns, may act in reliance
upon the City's declaration to construct the aforesaid primary access road and
shall have all rights, in law and equity, to seek the enforcement of this
declaration against the City of Paducah.
SECTION 4. That the Mayor is hereby authorized to execute any and
all documents necessary to effectuate the construction of the primary access
roadway in accordance with the Amended Development Plan of the Holt Road
Project.

SECTION 5. In order to accommodate the development within the
Holt Road development project and to expedite said development, an emergency is
hereby declared to exist and this ordinance shall become effective with one
reading.
