HomeMy WebLinkAbout93-5-4940ORDINANCE #93%L: 9Y AN ORDINANCE AUTHORIZING THE NEGOTIATION AND CONSUMMATION OF APPROPRIATE AGREEMENTS WHEREIN NEW FIRE APPARATUS IS ACQUIRED FROM EMERGENCY ONE, INC., IN AN AMOUNT NOT TO EXCEED $1,670,000.00 AND AUTHORIZING THE MAYOR TO EXECUTE A LEASE AGREEMENT WHEREIN THE CITY LEASES SAID FIRE APPARATUS DIRECTLY FROM A FINANCIAL INSTITUTION OR THROUGH THE CITY OF PADUCAH PUBLIC IMPROVEMENT CORPORATION WHEREAS, the City notified prospective bidder of its desire to receive bids for the ultimate acquisition of five (5) new engines, 1-75' aerial and 1-110' aerial pursuant to bid R.F.P. 92-10-3; and WHEREAS, the City received, reviewed, and duly considered proposals submitted in response to the aforesaid requests for proposals; and WHEREAS, the City has chosen Emergency One, Inc., to supply the desired fire apparatus for the City; and WHEREAS, the City now desires to negotiate a final agreement with Emergency One, Inc., detailing the apparatus, with consummation of same to be either through a lease transaction directly with a financial institution or a lease transaction through the City of Paducah Public Improvement Corporation. NOW, THEREFORE, be it ordained by the Board of Commissioners of the City of Paducah, as follows: SECTION 1. Upon the corporation counsel giving final approval as to the legal form of the appropriate agreements, the Mayor is hereby authorized to execute such agreements wherein a purchase of the fire apparatus is consummated with Emergency One, Inc., for a sum not in excess of $1,670,000.00. Purchase of the fire apparatus is to be consummated through a financial institution with a lease directly from the -financial institution to the City, or through the City of Paducah Public Improvement Corporation with a lease directly from the City of Paducah Public Improvement Corporation, directly to the City. SECTION 2. Any and all expenditures relating to the aforesaid fire apparatus shall be charged to Account No. SECTION 3. Failure of the parties to enter into an approved transaction as provided in Section 1 will render the authorization and approval set forth herein ineffectual and void. L -j -u-,T-F-1r� 127 SECTION 4.
