HomeMy WebLinkAbout93-7-4976185 ORDINANCE #93- 1 451 AN ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A PARCEL OF REAL PROPERTY FOR THE PURPOSES OF THE RECONSTRUCTION, ALTERATION, RELOCATION AND IMPROVEMENT OF A PERMANENT PUBLIC ROADWAY KNOWN AS COLEMAN ROAD AND A PERPETUAL PERMANENT UTILITY EASEMENT FOR PURPOSES OF LAYING, MAINTAINING, REPAIRING AND REMOVING PUBLIC UTILITIES ACROSS THE REAL PROPERTY OWNED BY LOYD CHAMPION AND WIFE, LOLA CHAMPION, AND AUTHORIZING THE CONDEMNATION OF SAME WHEREAS, it is in the public interest and a necessity for the City of Paducah, Kentucky, to acquire a parcel of real property consisting of 0.206 acres for the reconstruction, alteration, relocation and improvement of a permanent public roadway known as Coleman Road, which extends from U.S. 60 (Hinkleville Road) north to the city limits across the real property owned by Loyd Champion and wife, Lola Champion; and WHEREAS, it is necessary for the City of Paducah, Kentucky, to acquire the aforesaid real property in furtherance of the public purpose of constructing and maintaining its roadway system; and WHEREAS, it is in the public interest and a necessity for the City of Paducah, Kentucky, to acquire a certain perpetual permanent utility easement across the real property owned by Loyd Champion and wife, Lola Champion, for purposes of the construction and maintenance of all utilities by the City of Paducah, Kentucky; and WHEREAS, the aforesaid easement is needed by the City of Paducah, Kentucky, in furtherance of the public purpose of the City of Paducah to provide all essential utilities to its citizens; and WHEREAS, the City of Paducah, Kentucky, has been unable to contract or agree with the owners thereof for the acquisition or purchase of the real property and easement sought to be condemned; and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, do hereby authorize the condemnation of the herein described real property for purposes of the reconstruction, alteration, relocation, and improvement of the public roadway known as Coleman Road and a perpetual permanent utility easement as herein described, all of said property being owned by Loyd Champion and wife, Lola Champion, pursuant to the Kentucky Revised Statutes; 186 NOW, THEREFORE, be it ordained by the City of Paducah, Kentucky: SECTION 1.. That the corporate counsel of the City of Paducah, Kentucky, be and is hereby ordered and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City of Paducah, Kentucky, against Loyd Champion and wife, Lola Champion, and all other parties at interest to acquire the necessary real property and perpetual permanent easement rights across the subject property owned by the aforesaid persons. SECTION 2. That the real property and the perpetual permanent easement to be acquired is in McCracken County, Kentucky, and is more particularly described as follows: ROADWAY Beginning at a point in the existing West right of way line of Coleman Road, said point being located 10.73 feet right of Relocated Coleman Road station 45+93.85, thence North 68 degrees 01 minutes 57 seconds West, 52.46 feet to a point in the proposed right of way line, said point being located 40.00 feet left of Relocated Coleman Road station 45+80.66, thence, with the proposed right of way line, 184.83 feet along an arc to the right, having a radius of 1185.92 feet, the chord of which is North 40 degrees 51 minutes 27 seconds East, 184.64 feet to a point 40.00 feet left of Relocated Coleman Road station 47+59.25, thence South 68 degrees 01 minutes 57 seconds East, 45.81 feet to a point in the existing right of way line, said point being located 1.92 feet right of Relocated Coleman Road station 47+77.45, thence, with the existing right of way line, 22.34 feet along an arc to the left, having a radius of 455.74 feet, the chord of which is South 40 degrees 06 minutes 57 seconds West, 22.34 feet to a point 4.08 feet right of Relocated Coleman Road station 47+55.15, thence, continuing with the existing right of way line, South 38 degrees 42 minutes 41 seconds West, 160.26 feet to the point of beginning. The above described parcel contains 0.206 acres (8,982 sq.ft.) . UTILITY EASEMENT Beginning at a point 40.00 feet left of Relocated Coleman Road station 45+80.66, thence North 68 degrees 01 minutes 57 seconds West, 10.32 feet to a point 50.00 feet left of Relocated Coleman Road station 45+78.19 thence 184.64 feet along an arc to the right, having a radius of 1195.92 feet, the chord of which is North 40 degrees 41 minutes 33 seconds East, 184.46 feet to a point 50.00 feet left of Relocated Coleman Road station 47+55.12, thence South 68 degrees 01 minutes 57 seconds East, 10.88 feet to a point 40.00 feet left of Relocated Coleman Road station 47+59.25, thence 184.82 feet along an arc to the left, having a radius of 1185.92 feet, the chord of which is South 40 degrees 51 minutes 27 seconds West, 184.64 feet to the point of beginning. The above described parcel contains 0.042 acres (1,847 sq.ft.) . SECTION 3. This ordinance shall be read on two separate days and become effective upon publication of title or certified summary thereof. GERALDINE B.
