HomeMy WebLinkAbout93-7-4973180 'ORDINANCE #93-_7 - AN ORDINANCE AMENDING SECTIONS 10 AND 11 OF ORDINANCE 92-3-4739, AN ORDINANCE RELATING TO PROTECTION OF TREES ON PUBLIC PROPERTY WITHIN THE CITY OF PADUCAH WHEREAS, by Ordinance No. 92-3-4739, the City of Paducah adopted an ordinance relating to protection of trees on public property I within the City of Paducah; and WHEREAS, the City of Paducah does now desire to amend Sections 10 and 11 thereof; Paducah: NOW, THEREFORE, be it ordained by the City of SECTION 1.. Section 10 of Ordinance 92-3-4739 is hereby amended to read as follows: Section 10. Pruning, Corner Clearance. Every owner of any tree overhanging any street or right of way within the City shall prune the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection and so that there shall be a clear space of eight (8) feet above the surface of the street or sidewalk. Said owners shall remove all dead, diseased or dangerous trees or broken or decayed limbs which constitute a menace to the safety of the public. The City shall have the right to prune any tree or shrub on private property when it interferes with the proper spread of light along the street from a street light or interferes with visibility of any traffic control device or sign, or hinders passage of bedestrians or traffic on city richt of ways, or obstructs visibility of road intersections. SECTION 2. Section 11 is hereby amended to read as follows: Section 11. Dead or Diseased Tree Removal on Private Property. The City shall have the right to cause the removal of any dead or diseased trees on private property within the City when such trees �..,. rT ... I �_�_a �_ i 101 constitute a potential threat to other trees, people, or property within the City. The City Forester will notify in writing the owners of such trees. Removal shall be done by said owners at their own expenses within sixty (60) days after the date of service of notice. In the event of failure of owners to comply with such provisions, the City shall have the authority to remove such trees and charge the costs of removal errtzlte-owner'&-property tax r1et ee to the property owner. Should the property owner fail to pay =y� the invoice within sixty (60) days of notification, the City shall have the authority to file a lien against the property for the costs of the removal, plus interest at the maximum legal rate allowed by law, and the costs of filing said lien. SECTION 3. This ordinance shall be read on two separate days and become effective upon publication of title or certified summary thereof. GERALDINE B.
