AN ORDINANCE AMENDING SECTION 28-14,
°APPLICATION FOR STREET OR ALLEY CLOSING"
WHEREAS, Section 28-14, "Application for street or alley closing" of the
Code of Ordinances of the City of Paducah provides for the lawful application for street or
alley closing; and
WHEREAS, the Board of Commissioners desires to amend the provisions of
Section 28-14, as provided herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. Section 28-14, "Application for street or alley closing.", is
hereby amended to read as follows:
An applicant filing for the closing of any portion of a street or
alley shall file an application with the zoning administrator.
The application shall be accompanied by a professional
property survey of the street or alley requested to be closed
and an application fee of five hundred dollars ($500.00).
Said application is to mast be signed by all real property
owners whose land adjoins any part of the right-of-way
within the block of any section of right-of-way that is
proposed to be closed, provided however, the application
may be filed without the signature of all adjoining real
prope0y owners if the applicant(s) agree to be responsible
for those damages if any, that may be awarded pursuant to
KRS 82.405(2). (Ord. No. 86-6-2855, § 1,6-10-86)
SECTION 2. This ordinance shall be read on two separate days and will
become effective upon publication of the title and certified summary thereof.
