AN ORDINANCE REPEALING SECTIONS 7-7.5, 7-
7.6 AND 7-7.7 OF CHAPTER SEVEN, BUILDINGS
AND BUILDING REGULATIONS, AND ENACTING
SECTION 7-7.5, PROPERTY MAINTENANCE
CODE, OF THE CODE OF ORDINANCES OF THE
CITY OF PADUCAH.
WHEREAS, the City of Paducah adopted BOCA National
Property Maintenance Code, Third Edition, 1990, by Ordinance No. 91-6-
4626;
WHEREAS, the City now wishes to update said code by
adopting the Fourth Edition, 1993, of the above -referenced Code;
NOW, THEREFORE, be it ordained by the City of Paducah,
Kentucky, as follows:
SECTION 1.. Sections 7-7.5, 7-7.6 and 7-7.7 of Chapter 7,
Buildings and Building Maintenance, of the Code of Ordinances of the City
of Paducah, are hereby repealed.
SECTION 2. Section 7-7.5 of Chapter 7, Buildings and
Building Regulations, as hereby created and ordained to read as follows:
Section 7-7.5 Property Maintenance Code.
A. Code Adopted.
That a certain document, three copies of which are on file in
the office of the City Clerk of the City of Paducah, being marked and
designated as "The BOCA National Property Maintenance Code, Fourth
Edition, 1993" as published by the Building Officials and Code
Administrators, International, Inc., be and is hereby adopted as the
Property Maintenance Code of the City of Paducah, in the state of
Kentucky; for the control of buildings and structures as therein provided;
and each and all of the regulations, provisions, penalties, conditions, and
terms of said BOCA National Property Maintenance Code are hereby
referred to, adopted, and made a part hereof, as if fully set out in this
ordinance, with the additions, insertions, deletions and changes, if any,
prescribed in Section C of this ordinance.
B. Additions, Insertions and Changes.
That the BOCA National Property Maintenance Code is amended
and revised in the following respects:
1. Section PM -101.1(p . 1, second line) . Insert: City of
Paducah.

2. Section PM -106.2(p.3, third line) . Insert: $50.00,
$1,000.00.
3. Section PM -106.2(p.3, fourth line). Insert: 30 days.
4. Section PM -304.12(p.11, first line) . Insert: May 1 -
October 31.
5. Section PM -602.2.1(p.17, fifth line) . Insert:
September 1 -May 30.
6. Section PM -602.3(p.17, third line). Insert: September 1 -
May 30.
7. The term "Code official," as used in the BOCA National
Property Maintenance Code, shall be deemed to be either the City Building
Inspector, City Fire Marshall, or their duly authorized representatives,
and both shall be charged with the administration and enforcement of this
code.
8. The "Board of Appeals" referred to in the BOCA National
Property Maintenance Code shall be the Building Code Appeals Board of the
City of Paducah, as set forth in Section 7-20 of the Code of Ordinances of
the City of Paducah.
C. Saving Clause.
Nothing in this ordinance or in the property maintenance code
hereby adopted shall be construed to affect any suit or proceeding pending
in any court, or any rights acquired, or liability incurred, or any cause or
causes of action acquired or existing, under any act or ordinance hereby
repealed as cited in Section B of this ordinance; nor shall any just or legal
right or remedy of any character be lost, impaired or affected by this
ordinance.
D. Same -Conflicts.
If any conflicts exist between the BOCA National Property
Maintenance Code and the Kentucky Building Code, the Kentucky Building
Code shall take precedence and control over all such matters.
SECTION 3. This ordinance shall be read on two separate
days and will be become effective upon publication of title or certified
summary thereof.
