HomeMy WebLinkAbout93-8-4989204 3, 9 ORDINANCE #93 -9 -(49 -ole - AN 93 -9 -y9 -ole - AN ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A PARCEL OF REAL PROPERTY FOR THE PURPOSES OF THE RECONSTRUCTION, ALTERATION, RELOCATION, AND IMPROVEMENT OF A PERMANENT PUBLIC ROADWAY KNOWN AS COLEMAN ROAD AND A PERPETUAL PERMANENT UTILITY EASEMENT FOR PURPOSES OF LAYING, MAINTAINING REPAIRING, AND REMOVING PUBLIC UTILITIES ACROSS THE REAL PROPERTY OWNED BY DALMOS E. JOYCE, AND AUTHORIZING THE CONDEMNATION OF SAME WHEREAS, it is in the public interest and a necessity for the City of Paducah, Kentucky, to acquire a parcel of real property consisting of 0.669 acres for the reconstruction, alteration, relocation, and improvement of a permanent public roadway known as Coleman Road, which extends from U.S. 60 (Hinkleville Road) north to the city limits across the real property owned by Dalmos E. Joyce; and WHEREAS, it is necessary for the City of Paducah, Kentucky, to acquire the aforesaid real property in furtherance , of the public purpose of constructing and maintaining its roadway system; and WHEREAS, it is in the public interest and a necessity for the city of Paducah, Kentucky, to acquire a certain perpetual permanent utility easement across the real property owned by Dalmos E. Joyce, for purposes of the construction and maintenance of all utilities by the City of Paducah, Kentucky; and WHEREAS, the aforesaid easement is needed by the City of Paducah, Kentucky, in furtherance of the public purpose of the city of Paducah to provide all essential utilities to its citizens; and WHEREAS, the City of Paducah, Kentucky, has been unable to contract or agree with the owners thereof for the acquisition or purchase of the real property and easement sought to be condemned; and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, do hereby authorize the condemnation of the 1 205 herein described real property for the purposes of the reconstruction, alteration, relocation, and improvement of the public roadway known as Coleman Road and a perpetual permanent utility easement as herein described, all of said property being owned by Dalmos E. Joyce, pursuant to the Kentucky Revised Statutes; Kentucky; NOW, THEREFORE, be it ordained by the City of Paducah, SECTION 1. That the corporate counsel of the City of Paducah, Kentucky, be and is hereby ordered and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City of Paducah, Kentucky against Dalmos E. Joyce, and all other parties at interest to acquire the necessary real property and perpetual permanent easement rights across the subject property owned by the aforesaid persons. SECTION 2. That the real property and the perpetual permanent easement to be acquired is in McCracken County, Kentucky, and is more particularly described as follows: ROADWAY Beginning at a point in the existing right of way line of Coleman Road, said point being located 60.00 feet right of Relocated Coleman Road station 22+04.73, thence, with the proposed right of way line of Relocated Coleman Road, North 28 degrees 55 minutes 48 seconds West, 71.20 feet to a point 60.00 feet right of Relocated Coleman Road station 22+75.93, thence, continuing with the proposed right of way line, 66.31 feet along an arc to the right, having a radius of 512.96 feet, the chord of which is North 25 degrees 13 minutes 36 seconds West, 66.27 feet to a point 60.00 feet right of Relocated Coleman Road station 23+50.00, thence, continuing with the proposed right of way line, South 68 degrees 28 minutes 36 seconds West, 10.00 feet to a point 50.00 feet right of Relocated Coleman Road station 23+50.00, thence, continuing with the proposed right of way line, 319.46 feet along an arc to the right, having a radius of 522.96 feet, the chord of which is North 4 degrees 01 minutes 24 seconds West, 314.51 feet to a point 50.00 feet right of Relocated Coleman Road station 27+00.00, thence, continuing with the proposed right of way line, North 76 degrees 31 minutes 24 seconds West, 10.00 feet to a point 40.00 feet right of Relocated Coleman Road station 27+00.00, thence, continuing with the proposed right of way line, 138.64 feet along an arc to the right, having a radius of 532.96 feet, the chord of which is North 20 degrees 55 minutes 44 seconds East, 2 206 138.25 feet to a point 40.00 feet right of Relocated Coleman Road station 28+49.04, thence, continuing with the proposed right of way line, North 28 degrees 22 minutes 52 seconds East, 47.52 feet to a point in the North line of the herein described tract, said point being located 40.00 feet right of Relocated Coleman Road station 28+96.56, thence, with the North property line, North 61'degrees,28 minutes 07 seconds West, 16.86 feet to a point in the existing right of way line of Coleman Road, said point being located 23.14 feet right of Relocated Coleman Road station 28+96.61, thence, with the existinglright of way line, South 23 degrees 06 minutes 104 seconds West, 234.88 feet to a point 12.86 feet right of Relocated Coleman Road station 26+54.74, thence, continuing with the existinglright of way line, South 12 degrees 35 minutes 14 seconds West, 189.78 feet to a point 29.71 feet left of Relocated Coleman Road station 24+71.58, thence, continuing with the existing right of way line, 152.98 feet along an arc to the left, having a radius of 125.00 feet, the chord of which is South 22 degrees 28 minutes 24 seconds East, 143.61 feet to a point 14.05 feet left of Relocated Coleman Road station 23+33.74, thence, continuing with the existing right of way line, South 57 degrees 32 minutes 02 seconds East, 148.44 feet to the point of beginning. The above described parcel contains 0.669 acres (29,120 sq.ft.). The above described parcel contains 0.177 acres (7,720 sq.ft.). SECTION 3.
