HomeMy WebLinkAbout93-8-4987200 ORDINANCE NO. 93-8-1-1967 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED ON FRIEDMAN LANE FROM R-2, LOW DENSITY RESIDENTIAL AND R-4, HIGH DENSITY RESIDENTIAL TO POP, PLANNED OFFICE PARK ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS f TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on August 2, 1993, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED ON FRIEDMAN LANE FROM R-2, LOW DENSITY RESIDENTIAL AND R-4, HIGH DENSITY RESIDENTIAL TO POP, PLANNED OFFICE PARK ZONE," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from R-2, Low Density Residential and R-4, High Density Residential to J POP, Planned Office Park: Beginning at a concrete monument set at the southeast corner of tract 2 as shown on the plat of record in plat section "H" page 349, at a corner common to the lands now or formerly owned by William 0. Walker in the west right-of-way line of Friedman Lane, said monument being located approximately 742.6' southeasterly along the right-of-way line of Friedman Lane from its intersection with the south right-of-way line of US Highway 60 (Hinkleville Road); thence, from the point of beginning and with the north line of the aforementioned Walker property, south 46° 56109" west a distance of 297.46' to a concrete monument corner common to the said Walker property at the southwest corner of tract 1A as shown on the plat of record in plat section "J" Page 650; thence, with the west line of said Walker property, south 48° 12' 28" east a distance of 99.82' to a concrete monument corner common to the said Walker property in the north line of the parcel "B" as shown on the plat of record in plat section "J" page 1222, said parcel "B" being owned by William and Carolyn Skinner as shown by deed of record in deed book 707 Page 820; thence, with the north line of the said Skinner property, south 480 01' 52" west a distance of 85.00 feet to an iron pin; thence, with the west line of the said Skinner property south 420 58' 08" east a distance of 100.00' to an iron pin; thence, continuing with the west line of said Skinner property, south 780 O1' 40" east a distance of 102.43' to an iron pin; thence, with the south line of the said Skinner property, north 11° 58' 20" east to an iron pin; thence, continuing with the south line of the said 201 m!1®e�E�l�I®Pla!!�e�A�el�IlEI�III!II�AlX11!!�!�R!�!I!�!!!�!�IAIIAI�IA��I!!I��III!III�I��IIIR�AIIIIIIAlII�1� Skinner property and a 406.97' radius curve to the right, an arc distance of 84.28 feet to an iron pin, said arc subtended to a chord bearing of Y north 170 54' 17" east and a chord distance of 84.131; thence, with the east line of the said Skinner property, north 480 58' 46" west a distance of 32.92' to a concrete monument set at a corner common to the William and Faye South property as shown in deed of record deed book 654 Page 82; thence, with the south line of the aforementioned South property, north 480 58' 20" east a distance of 200.00' to an iron pin in the west right-of-way line of Friedman Lane; thence, with the west right-of-way line of Friedman Lane, south 480 52' 51" east a distance of 68.32' to an iron pin '.*set at the northeast of parcel "A" as shown on the plat of record plat section "J" Page 1222, said parcel "A'' owned by William H. & Terri Skinner as shown in deed of record deed book 747 Page 561; thence, with the north line of the said Skinner property and with a 20.00' radius curve to the left, an arc distance of 29.37' to an iron pin, said arc subtended by a chord bearing of south 890 00' 35" west and a chord distance of 26.801; thence, continuing with the north line of the said Skinner property, south 460 58' 20" west a distance of 23.75 feet to an iron pin; thence, continuing with the north line of the said Skinner property and a 356.97' radius to the left an arc distance of 218.06' to an iron pin, said are subtended by a chord bearing of south 290 28' 20" west and a chord distance of 214.691; thence, continuing with the north line of the said Skinner property, south 11°58' 20" west a distance of � 58.36' to an iron pin; thence, with lines common to the said Skinner property as follows: south 480 12' 28" east a distance of 148.90' to an iron pin, south 00 24' 33" west a distance of 159.20' to an iron pin, south 170 38' 33" west a distance of 190.00' to an iron pin, north 48° 12' 28" west a distance of 169.75' to an iron pin, south 48° 34' 03" west a distance of 125.00 feet to an iron pin, and south 480 12' 28" east a distance of 200.00' to an iron pin set in the north line of the Halehaven Subdivision as shown on plat of record plat section "G" Page 202, as amended in plat section "H" Page 7 and as amended in plat section "J" Page 1238; thence, with the north line of the Halehaven Subdivision, south 48° 34' 03" west a distance of 131.33' to a concrete monument set at the northwest of the Albany Road right-of- way; thence, continuing with the north line of the Halehaven Subdivision, south 48° 36' 47" west a distance of 1098.56' to an iron pin in the east right-of-way line of Interstate Highway 24; thence, with the said east right-of-way line of the interstate, north 40° 38' 09" west a distance of 290.89' to a cap and nail set in concrete; thence, continuing with the east right-of-way line of the interstate north 400 37' 22" west a distance of 452.17' to a point, said point being a corner common to the Mid America Hotels Corp. property as shown on the plat of record in plat section "K" Page 606 and as shown in the deed or record deed book 702 Page 698; thence, with the line of agreement established by the Quit Claim Deed of record in deed book 735 Page 22, north 46° 48' 42" east a distance of 1593.22' to an iron pin set at a corner common to the Louise M. Beaton property as shown in the deed or record deed book 375 Page 298; thence, with the west line of the Beaton property, south 480 43' 58" east a distance 202 of 254.11' to an iron pin set at the northwest corner of tract 1A as shown on the plat of record in plat section "J" Page 650; thence, with the south line of the said Beaton property north 460 56' 09" east a distance of 257.11' to an iron pin; thence, with a 20.00' radius curve to the left, an arc distance of 33.49' to an iron pin in the west right-of-way line of Friedman Lane, said are subtended by a chord bearing of north 1° 02' 18" west and a chord distance of 29.711; thence, with the west right-of-way line of Friedman Lane, south 48° 57' 44" east a distance of 10.08' to a point; � thence, with offset line in the west right-of-way line of Friedman Lane, north 410 O1' 30" east a distance of 15.00' to an iron pin; thence, continuing with the west right-of-way line of Friedman Lane, south 480 38' 19" east a distance of 213.89' back to the point of beginning. The above described parcel of land contains 41.608 acres, and is known as the Computer Services Incorporated property as shown in the deed of record in Deed Book 755 Page 501 and Deed Book 783, Page 136 both of record in the office of the McCracken County Court Clerk, Paducah, McCracken County, Kentucky. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5.
