AN ORDINANCE APPROVING A SETTLEMENT AGREEMENT WITH PAUL H.
LEGEAY
WHEREAS, Paul H. Legeay filed a civil action against the City
of Paducah and McCracken County in the United States District Court,
1 Western District of Kentucky, Civil Action No. C-87-0279P(J); and
WHEREAS, in said Civil Action Paul H. Legeay requested an
injunction against the City and McCracken County to cease operation of
the Paducah and McCracken County landfills; and
WHEREAS, in said Civil Action Paul H. Legeay requested an
injunction for alleged violations of the "Clean Water Act"; and
WHEREAS, Paul H. Legeay claimed damages to his real estate
which adjoins the above-mentioned landfills; and
WHEREAS, the parties have agreed to settle and resolve the
dispute between them as they relate to the action filed by Paul H.
Legeay.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Board of Commissioners approve and
authorize the Mayor to sign a "Settlement Agreement" between Paul H.
Legeay, the City of Paducah, and McCracken County, settling Civil
Action No. C-87-0268P(J) in the United States District Court for the
Western District of Kentucky.
SECTION 1. The City Treasurer is authorized to issue a check
made payable to Paul H. Legeay, and his attorneys, in the amount of
$35,000.00 as the City's portion of the Settlement Agreement.
SECTION 3. In order to settle this matter and expedite the
Settlement Agreement, an emergency is declared to exist and this
ordinance shall be effective upon one reading.
SECTION 4. This ordinance shall be published by a certified
