HomeMy WebLinkAbout88-5-4051324 ORDINANCE NO. 88-5-4051 AN ORDINANCE REVERSING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY LOCATED ON PARK AVENUE WEST OF LEVIN AVENUE, AND DIRECTING AN AMENDMENT TO THE PADUCAH ZONING ORDINANCE - 1976, SO AS TO CHANGE THE ZONE CLASSIFICATION FROM R-4, HIGH DENSITY RESIDENTIAL ZONE, TO B-1, CONVENIENCE AND SERVICE ZONE WHEREAS, the Paducah Planning Commission at a Public Hearing held on November 16, 1987, considered a proposal to amend the Paducah Zoning Ordinance -.1976, so as to change the zone classification of certain property located on Park Avenue west of Levin Avenue from R-4, High Density Residential Zone, to B-1, Convenience and Service Zone; and WHEREAS, the aforesaid proposal failed by reason of a nega- tive vote, and WHEREAS,.after_considering the evidence submitted and being thoroughly advised in the premises; the Board of Commissioners does by this ordinance overrule and reverse.the.action.of the Paducah Planning Commission. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF'THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Board of Commissioners finds, relative to the proposed amendment as follows: 1. The property proposed to be rezoned is presently zoned B-1 on the front 150 feet of the property. 2. The area on U.S. Highway 60 has developed numerous businesses, including a racetrack and numerous automobile dealerships in the immediate vicinity of the area being requested to be rezoned. 3. The property proposed to be rezoned adjoins the earthen floodwall of,the City of Paducah on one side and is more identifiable with the property presently zoned B-1 than the property zoned for residential use. 4. Park Avenue (U.S. Highway 60) has been widened since the adoption of the Comprehensive Plan and can handle any increased traffic created by the rezoning of this parcel. SECTION 2. That the Paducah Zoning Ordinance -1976, be amended so as to change the zone classification for the following property from R-4, High Density Residential Zone, to B-1, Convenience and Service Zone: Beginning where the northerly line of the herein described property intersects the center line of Levin Avenue, said point of intersection being located 183 feet south of the original center line of Park Avenue as measured along the center line of Levin Avenue; thence in a southerly direction along the center line of Levin Avenue, 93.6 feet to the point of intersection of said center line with the northerly line, if extended, of property presently owned by Lonnie Crowdus, et al; thence in a westerly direction along and with the northerly line of said Crowdus property and an extension thereof 175 feet to the northwest.corner of said property; thence in a southerly direction along and with the westerly line of said Crowdus property and the westerly line of a 50 foot wide lot also presently owned by Crowdus, 190 feet to the northerly line of a lot presently owned by Zola O.C. Brown; thence in a westerly direction along and with the Brown's line, 27:0 feet .to the easterly line of,a tract of land owned by Johnny box; thence in a northerly direction along and with the easterly line of said Box property, 283.6 feet to a point 149 feet south of the southerly right-of-way line of Park Avenue; thence in an easterly direction along and with a line 183 feet south of and parallel with the original center line of Park Avenue, 445 feet to the point of beginning. SECTION 3. That if any section, paragraph, or provision of l' this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separate from all other sections, paragraphs and provisions. SECTION 4. This ordinance shall be read on two separate days and shall be in full force and effect from and after its adoption. GERRY B.
