ORDINANCE NO. 88-8- *+1.8 -
AN ORDINANCE AMENDING CHAPTER 20, MOTOR VEHICLES AND TRAFFIC,
ARTICLE VIII, TRUCKS, TRAILERS AND SEMITRAILERS
WHEREAS, the Board of Commissioners finds that trucks of
excessive size and weight being operated on city streets are dangerous
to traffic and constitute a danger of damaging city streets; and
WHEREAS, the Board of Commissioners reaffirms and/or amends
the ordinances of the City of Paducah dealing with trucks, trailers and
semitrailers.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Sec. 20-166, Definitions -Motor truck, is
hereby reordained to read as follows:
"As used in this article, the term 'motor truck' means any
motor propelled vehicle designed for carrying freight or merchandise.
It shall not include self-propelled vehicles designed primarily for
passenger transportation, but equipped with frames, racks or bodies
having -a -lead license capacity under KRS 186.050 of not exceeding one
ten thousand (1 10,000) pounds."�:
SECTION 2. That Sec. 20-167, Same -Semitrailer, is hereby
reordained to read as follows:
"The term 'semitrailer', as used in this article, means a
vehicle designed to be attached to, and having its front end supported
by, a motor truck or truck -trailer, intended for the carrying of
freight or merchandise and having a load capacity of over one thousand
(1,000) pounds."
SECTION 3. That Sec. 20-168, Same -Trailer, is hereby
reordained to read as follows:
"As used in this article, the word 'trailer' means a vehicle
designed to be drawn by a motor truck or truck -tractor, but supported
wholly upon its own wheels, intended for the carrying of freight or�
merchandise and having a load capacity of over one thousand (1,000)
pounds."
SECTION 4. That Sec. 20-169, More than two trailers in one
unit prohibited, is hereby reordained to read as follows:

"No person shall operate.on any streets or public ways of the
city more than two (2)' trailers in any one unit." -
SECTION: 5.-- That- Sect 20-170, Maximum weight generally, is
hereby reordained to read as follows:
"Except as otherwise provided in Section 20-171, 20-173 of
the Code of Ordinances, no person shall park or operate on any street
or public way of the city any motor truck, semitrailer or trailer
except for the purpose of making deliveries or pick up of goods." the

SECTION 6. That Sec. 20-171, Maximum weight on street
designated as state or federal highway, or connecting link street, or
within fifteen miles of city limits, is hereby reordained to read as
follows:

SECTION 7. That Sec. 20-173.5, Vehicles to use only
prescribed streets, is hereby created to read as follows:
"(a) Motor trucks, semitrailers or trailers may be operated
only on the following streets and public ways of the city:
(1) Third Street, from Park Avenue to Whayne Sullivan Drive;
(2) Fourth Street, from South Third Street to Irvin Cobb
Drive;
(3) Sixth Street, from Kentucky Avenue to Broad Street;
(4) Eighth Street, from Clay Street to city limits;
(5) Thirteenth Street, from Kentucky Avenue to Cairo Road;
(6) Twenty -First Street, from Kentucky Avenue to Old
Road
(7) Twenty -Eighth Street, from Jackson Street to Park
Avenue;
(8) Alben Barkley Drive, from Lone Oak Road to city limits;
(9) Bridge Street, from Broad Street to city limits;
(10) Broad Street, from South Sixth Street to Bridge Street;
(11) Cairo Road, from Thirteenth Street to city limits;
(12) Cobb Drive, from Twenty -First Street to city limits;
(13) Hinkleville Road, from Park Avenue to city limits;
(14) Jackson Street, from Ohio Street to Lone Oak Road;
(15) Kentucky Avenue, from Third Street to Twenty -Eighth
Street;
(16) Lone Oak Road, from Broadway to city limits;
(17) H.C. Mathis Drive, from Twenty -Eighty Street (Joe
Clifton Drive) to North Eighth Street;
(18) Old Mayfield Road, from Twenty -First & Cobb Drive to
city limits;
(19) Ohio Street, from Cobb Drive to Jackson Street;
(20) Park Avenue, from Fifth Street to Hinkleville Road;

"(b) Nothing in this section shall be deemed to affect the
provisions of Section 12-2 of this Code or permit the operation of any
vehicle in violation of such section."
. SECTION 8 That Sec..:20-174:, Maximum height, is hereby
reordained to,read as follows:
"No person shall operate on any street or public way of the
city any motor truck, semitrailer or trailer the height of which,
including any part of body-'eor load.; shall -exceed thirteen and one-half
(131-2) feet, but nothing herein contained shall be construed to require
the -public authorities of the city to provide sufficient vertical
clearance to permit the operation of vehicles with a height of thirteen
and one-half (13%) feet, or any height."
SECTION 9. That Sec. 20-175, Maximum width, is'hereby
reordained to read as follows:
"No person shall operate on:any street or public way of the
city any motor truck or semitrailer the width of which; including any
part of body:or load, shall exceed eight (8) feet."
SECTION 10. That Sec. 20-176, Maximum length, is hereby
reordained to read as follows:
"No person shall operate on any street or public way of the
city any motor truck the length of which, including any part of body or
load, shall exceed eh -e forty (--) (40) feet, nor any
semitrailer, trailer or vehicle, or combination of vehicles, the length
of which, including any part of body or load, shall exceed sixty-five
(65) feet."
SECTION 11. That Sec. 20.-177, Equipment to conform to state
law, is hereby reordained to read as follows:
".No person shall-operate'any,motor truck; semitrailer or
trailer on any - street.or--public way. of .the city unless the,=same is
eq:uipp:ed zo-as-to-.conform to�the. laws of the Commonwealth of Kentucky."
SECTION 12. That Sec. 20-178, Requirements for hauling coal,
broken..stone or masonry, -.or gravel, is hereby.reordained to read as
follows: _

SECTION 13. That Sec. 20-180, Semitrailers and trailers
prohibited in certain alleys, is hereby reordained to read as follows:
"No person shall operate any -motor truck or truck trailer
with either a semitrailer or trailer attached thereto in any public
alley ten (10) feet or less in width in that area of the city which is
bounded on the south by the .north.line of Clark Street, on the west by
the east line of Seventh Street, on the north by the south line of
Madison Street and on the east by the.low watermark of the Ohio River."

SECTION 14�. That Sec:.. 20-182,'Semitrailers and trailers
prohibited on certain streets between 8&:0-0 a.m:. and 5:30. p.m.,. is
hereby reordained to read as follows:
"It shall be unlawful for; any person, firm, 'company or
corporation to, at any -time between the hours of 8:00 a.m. and 5:30
p.m., seven (7) days per week, operate any motor truck -of more than a
four, -(4) -ton-.edpacity'- of truck tracto-r with- either` a �emktrailer or
trailer attached thereto, as defined in this article, without being
escorted by a police cruiser, upon the---fol-lowings-treets in 'the City of
Paducah-, Kentub-ky :

SECTION .15. That Sec: 20-186; Temporary special permit for
vehicles exceeding..l.imitat.ions prescribed,by article -Authority to
issue; application, is hereby reordained to read as follows:
"(a) The city manager may, in his discretion, upon
application..in.writing and.good cause being shown therefor, issue a
temporary special permit, in writing, authorizing the applicant to
operate or move a motor vehicle, or combination of vehicles, of a size,
weight,. length,.width or height exceeding.the maximums provided for in
this article. The application for such special permit shall state the
proposed -maximum wheel loads, maximum axle loads, and the minimum axle
spacing of such vehicles or combinations thereof, and the height,
width, and length of such vehicles with their load, and the specific

streets or public ways over which the permit for such operation is
requested and the.time of such operation., Such application shall also
state whether:the permit is :requested for a'single-trip or for
continued operation. The city manager is authorized, in his
discretion, to issue or refuse .to issue.such.permit;:
"(b) No temporary special permit shall be -issued -under this
section authorizing the violation of any'provision of section 20-178,
89-149, 20-180,:88-181 or 20-182:"
SECTION 16. That Sec. 20-187, Same -Conditions may be
imposed, is hereby reordained to read as follows:
"When a temporary special permit authorized by section 20-186
is issued, the city manager may, in his discretion, limit the number of
trips to.be made thereunder, establish seasonal or.other .gime
limitations, designate routes over which the vehicles described in the
permit may operate on the streets or public ways of the city, and he
may otherwise limit the -prescribed conditions of. .operation of such
vehicles when necessary to assure against undue damage to the street
foundation by such vehicle,.if,,in his opinion, such operation may
damage the streets or public ways, and may require ,the applicant to .
give bond,.with sufficient surety to be approved by him,.toindemnify
the city against any damage which.might occur to..petsons.or property by
reason of the operation under such special.permit."
SECTION 17. That Sec. 20=1.88, Same -Fee; permittee not
obligated to -obtain license.requiied by -section 20-.183, is hereby
reordained to read as follows:
"The fee charged for each temporary special permit authorized
by section 20-186 shall be twenty five -dollars 0-4-25.00). _A-persex

SECTION 18. That Sec: 20=189,'Same=To be_carried_in vehicle;
inspection; compliance with terms, is hereby reordained to:read as
follows:
"A temporary special permit issued:pursuant:.to_sections
20-186 through 20-188 shall be carried in the vehicle or_combination.of
vehicles to which it refers and shall be open to inspection by any

peace officer, and any operation or use of vehicles.under such permit
shall be in strict conformity -with -the terms thereof."
SECTION 19. ,That Sec. 20 -190;: -License or,special permit
issued under article does not exempt holder for compliance-with-other-
ordinances,

"The issuance of a license or a temporary special permit
under this article shall not be construed to exempt the holder thereof
from the obligations of compliance with any and all other applicable
provisions of this Code or other ordinances of the city."
SECTION 20. That..Se.c. 20-191, Authority of.police to stop
vehicle and.determine compliance with article, is hereby reordained to
read as follows:
"Any police officer, of -the city shall have the right to stop
the operator of any motor truck, semitrailer or trailer in order to
make measurements as to.the length, width, height or weight of such
equipment and load -and may require the driver.thereof to proceed to a
scale:to ascertain whether or not such equipment exceeds .the maximum
limitations prescribed in this article. -The fee for the use of such
scale shall be paid by the operator'of such equipment" .
SECTION 21. That.Sec. 20-192, Disposition of money collected
under article, is hereby reordained to read as follows:
"All money c.o.11ected under the provisions of this article
shall be..paid..into, and bec.ome_part,of, the general fund of the city."
SECTION. 22. That Sec. 20-193, Penalty.for violations of
article, is hereby reordained to read as follows:
"Anyperson who violates any provision of this article shall
be.guilty of a.z+edemeeaer violation and, upon conviction thereof,
unless otherwise specifically provided, shall be fined not less than
tee twenty five dollars ($�9 25.00) nor.more than ene-headred,two
hundred fifty.dollars ($1-88..250.00). Each day such person violates any
provisionof this article shall be considered a separate offense.",TI,
SECTION 23. The following sections of the Code of Ordinances
are repealed in their entirety: Sections 20-172, 20-173, 20-179,
20-181, 20-183, 20-184 and 20-185.
SECTION 24. This ordinance shall be read on two separate
days and will become effective upon publication of title and a
certified summary thereof.
