HomeMy WebLinkAbout88-7-4097M-1 -moo ? 7 ORDINANCE NO. 88-7-40916- AN 8-7409fr AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION SO AS TO DENY THE ZONING CLASSIFICATION FROM R-3 TO R-4 ON THE PROPOSED REZONING OF PROPERTY LOCATED IN AN AREA BOUNDED BY JEFFERSON, MONROE, NORTH 30TH AND NORTH 31ST STREETS WHEREAS, the Paducah Planning Commission at a Public Hearing held on February 1, 1988, considered a proposal to amend the Paducah Zoning Ordinance - 1976, so as to change the zone classification of certain property located in an area bounded by Jefferson, Monroe, North 30th and North 31st Streets from R-3, Medium Density Residential Zone, to R-4, High Density Residential Zone; and WHEREAS, the aforesaid proposal was denied by the Planning Commission; and WHEREAS, on April 4, 1988, the Planning Commission denied a request to reconsider its denial of the requested zoning change of February 1, 1988; and WHEREAS, the developer has requested the Board of Commis- sioners to overrule the Planning Commission; and WHEREAS, the Board of Commissioners wishes to adopt the Findings of Fact and Recommendations of the Planning Commission as that of the Board of Commissioners. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Board of Commissioners finds, relating to the proposed amendment as follows: (1) The original zoning classification given the property was appropriate and proper; (2) There had been no major changes of an economic, physical or social nature within the area involved as to warrant a change in zoning; g. (3) Paducah's Comprehensive Plan calls for residential property only; (4) Approximately 70 to 75 people attending the hearing and opposed the zoning change by standing; (5) A petition containing 228 signatures opposing the zoning change was presented to the Planning Commission. SECTION 2. The application to amend the Paducah Zoning Ordinance -1976 so as to change the zoning z1assif ication for the following property from R-3, Medium Density Residential Zone, to R-4,. High Density Residential Zone is hereby denied: Beginning at a point in the center. line'of Jefferson Street, said point being the intersection of Jefferson Street and North 31st Street; thence in a northerly direction a.dis.tance of 412.5 feet to the center line of the intersection of North 31st Street and Monroe Street; thence in an easterly direction a distance of 458 feet to the center line of the intersection of Monroe Street and North 30th Street; thence in a southerly direction a distance of 412.5 feet to the centerline. of the intersection of North 30th Street and Jefferson Street; thence in a westerly direction a distance of 458 feet to the point of beginning. SECTION 3. This ordinance shall be read on two separate days and shall be in full force and effect from and after its adoption.
