ORDINANCE NO. 88 -7 -109 -5 -
AN ORDINANCE APPROVING THE CLOSING OF CERTAIN PORTIONS OF
STREETS LOCATED IN THE FAIRFIELD SUBDIVISION
WHEREAS,. Peoples First National Bank and Trust Company, as
Trustee for the Martin Conrad Estate, has requested that certain
portions of the right-of-ways.lo:cated..in Fairfield Subdivision be
closed, a description of said_portions.of right-of-ways being described
herein; and
WHEREAS, the Planning Commission approved this closing on
June 6, 1988; and
WHEREAS, the Board of Commissioners finds that these right-
of-ways are unimproved and are not needed as public right-of-ways.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY
SECTION 1. The City of Paducah does hereby authorize the
closing of the -portions of .the ,streets ,.located in -the... --Fairfield
Subdivision, which are more particularly'described as -follows:
Tract _I-. Fairfield. S<ubdivision.,:,Alameda Drive East
Beginning -at the point of intersection of the south line
of Alameda Drive :East and the.west.line of ._Friedman Lane as
shown on Section II of Conrad Heights Subdivision and
recorded in Plat Book D, page 46, of the -McCracken County
Court Clerk's Office; thence in a westerly direction at an
internal angle of 90° from the west line of Friedman Lane and
along the south line of Alameda Drive East a.. distance of
120.00 feet; thence continuing along the south line of
Alameda Drive East along a tangential arc curving to the left
an arc distance of 113;11 feet, said arc having a radius of
673.98 feet, and said arc subtending a central angle of 9°36'
5.5"; -thence in a northerly direction along -an arc curving to
the left,.for-an arc distance of 80:40 feet to a point in the
north line of Alameda, Drive East,. said arc. -.-beginning as
tangential to the normal or radial. line ending the previous
curve, said arc having a radius of 50.00 feet and said arc
subtending a central angle of 92°07'33"; thence with the
.north line.of.Alameda Drive East and in an easterly direction
along an arc curving to the right for an arc distance of
175.22 -feet, said arc beginningg-tangent :to and concentric
with the ending point of the previous curve and said arc
having,a radius..of 723.98 feet and said arc:,subtendinga
central angle of 13°52'01"; thence continuing with the north
line of Alameda Drive East in an easterly direction
tangential to the curve a distance of 120.00 feet to the west
line of Friedman Lane;: -thence with an internal angle of 90°
and in a southerly direction a distance of 50.00 feet to`;the
point of, beginning.
Tract II. Fairfield Subdivision, Brookline Drive
Beginning at the point of intersection of the south line of
Brookline Drive and west line of Friedman Lane as shown on
Section I of Conrad Heights Subdivision and recorded in Plat
ON
Book D, page 39, of the McCracken County Court Clerk's
office; thence in a westerly direction at an internal angle
of 90° from the west line of Friedman Lane and along the
south line of Brookline Drive a distance of 73.28 feet;
thence continuing along the south line of Brookline Drive
along a tangential arc curving to the right an arc distance
of 109.91 feet, said arc having a radius of 1457.78 feet, and
said arc subtending a central angle of 4°19'11"; thence in a
northerly direction along an arc curving to the left, for an
arc distance of 53.91 feet to the point in the north line of
Brookline Drive, said arc beginning as tangential to the
normal or radial line ending the previous curve, said arc
having a radius of 50.00 feet and said arc subtending a
central angle of 61°46'25"; thence with the north line of
Brookline Drive and in an easterly direction along an arc
curving to the left for an arc distance of 117.57 feet, said
arc beginning tangent to and concentric with the ending point
of the previous curve and said arc having a radius of 1407.78
feet and said arc subtending a central angle of 4°47'05";
thence continuing with the north line of Brookline Drive in
an easterly direction tangential to the curve a distance of
73.28 feet to the west line of Friedman Lane; thence with an
internal angle of 90° and in a southerly direction a distance
of 50.00 feet to the point of beginning.
Tract III. Fairfield Subdivision, Newton Road
Commencing at the point of intersection of the south line of
Newton Road with the west=line of Alameda.,Drive.-_South; thence
with the south line of Newton Road at an angle of 90° from
the west- line of -said.Alameda.Drive and in a westerly
direction a distance of 94.79 feet; thence continuing with
the south line of Newton Road along an arc' 'curving to the
left an arc distance of 306.95 feet (307.25 on Conrad Heights
Plat),,..said arc' having a :radius. of 292.94 feet and said arc
being subtended by a chord forming an angle to the right from
the last call of 149°58'54" to the point of beginning; thence
continuing in a westerly direction and with an angle to the
right of 149°58'53" from the chord of the last call, a
distance of 10.01 feet; thence with an internal angle of
69°46'34" measured to the left from the last call, a distance
of 15.27 feet to a point in the east right of way of
Interstate Highway No. I-24; thence in a northerly direction
along said east right of way line of I-24 and with an
internal angle of 148°25'35" measured to the left from the
last call, a distance of 18.13 feet; thence continuing with
said east right of way line in a northerly direction and with
an internal angle measured to the left from the last call of
179°26'56" a distance of 1.48 feet; thence in a southeasterly
direction with an internal angle of 31°38'36" measured to the
left from the last call, a- distance of 32.05 feet to the
point of beginning.
SECTION 2. The Corporation Counsel of the City of Paducah,
Kentucky, be, and he is hereby, authorized, empowered and directed to
institute and prosecute, pursuant to KRS 82.405, an action in McCracken
Circuit Court for a judgment ordering the closing of the portions of
the streets described in Section 1 above.
SECTION 3. This ordinance shall'be read on two separate days
and will be effective upon publication of title and a certified summary
thereof.. -
